I think larby's friends need to buy him the best lawyers and fight this case cause everything past point 23 in the injunction is a little iffy
 
Goddamn this shit is getting pretty serious... Rachael Ray seems to be the next big target for acai berry, I wonder when she will start gathering her attorneys and going after affiliates.. it's starting to become a trend.

I wonder why they're not going after the advertisers. the points made above concern the advertisers' landing pages, as far as I can see.

Rachel Ray show also = Harpo. Some affiliates are going to be busted big time there, since it's gone from "featured on Rachel Ray" to "Rachel Ray's diet" to "Rachel Ray lost 34 lbs" to that + her image on banners... still being run today.
 
The injunction filed with he court sure is interesting. Impressive how the judicial branch closed a 15 year technology gap and went from not being able to differentiate emails from website to having down the latest lingo, talking about traffic and flogs...

the Attorney general probably ordered acai for her self lol and thats what finally made her crack or Oprah lawyers in Illinois convinced her since she owns Chicago.

I have a feeling this is going to get ugly. IL AG elections are coming up (I believe in Feb of 2010). Gives the biggest incentive to "fight" for the people of IL tooth and nail. Esp with the Harpo group pushing its agenda.

The restitution piece of the complaint could get expensive depending on how deep they dig. I just have a feeling this is going to get drug out for a while. Hopefully all you young cats are putting some cash in AG/FTC account some where so when they come a knockin you are out on your ass.
 
$50,000 PER Violation... yikes.

And this isn't only Harpo and Ophra... half of the file was about deceptive "flogs" selling "rebills"... and yes, they did use those terms many times.
