I've heard a couple affiliates say they're excited about June 4th, because Google will no longer protect trademarked terms.

Kris at CashTactics wrote about it here:

But it really doesn't mean shit. If you read carefully, the "new" policy just allows you to bid on trademarked keywords, but you still can't use them in your ads - Which is exactly how it is now.

See here:

That's the link referenced in Kris's post. If you read the title of the doc, it's "Regions for which Google will not investigate the use of trademarks as keywords."

Just to double check, I called the Google Suicide Hotline and asked. Not that they're very useful, but they confirmed that you still can't use trademarked terms in your ads on June 4th.

Basically, nothing's changed.

In the US, our policy permits use of the trademark in the ad text in the following circumstances:

As a provider of space for advertisements, please note that Google is not in a position to arbitrate trademark disputes between the advertisers and trademark owners. As stated in our Terms and Conditions, the advertisers themselves are responsible for the keywords and ad content that they choose to use. Accordingly, we encourage trademark owners to resolve their disputes directly with the advertisers, particularly because the advertisers may have similar advertisements on other sites.
As a courtesy to trademark owners, however, we are willing to perform a limited investigation of reasonable complaints about use of trademarks in ads. In the US, our policy permits use of the trademark in the ad text in the following circumstances:

  • Ads which use the term in a descriptive or generic way, and not in reference to the trademark owner or the goods or services corresponding to the trademark term.
  • Ads which use the trademark in a nominative manner to refer to the trademark or its owner, specifically:
    • Resale of the trademarked goods or services: The advertiser's site must sell (or clearly facilitate the sale of) the goods or services corresponding to a trademark term. The landing page of the ad must clearly demonstrate that a user is able to purchase the goods or services corresponding to a trademark from the advertiser.
    • Sale of components, replacement parts or compatible products corresponding to a trademark: The advertiser’s site must sell (or clearly facilitate the sale of) the components, replacement parts or compatible products relating to the goods or services of the trademark. The advertiser’s landing page must clearly demonstrate that a user is able to purchase the components, parts or compatible products corresponding to the trademark term from the advertiser.
    • Informational sites: The primary purpose of the advertiser’s site must be to provide non-competitive and informative details about the goods or services corresponding to the trademark term. Additionally, the advertiser may not sell or facilitate the sale of the goods or services of a competitor of the trademark owner.

Actually it does matter for some niches. I bid on trademark keywords in one niche I'm in (because I have a direct contract with the advertiser, and I am allowed to) and Google doesn't always display my ads when I search for those keywords, and as of June 4th, they will. It will definitely help my business. So yeah, your facts are off.

Well, that may or may not have anything to do with you bidding on trademarked keywords. You could just be getting low share or voice, ad now showing for QS or a million other reasons.

Only *once* ever have I tried to upload a campaign and have them say "You can't bid on this keyword for trademarked reasons." Every other time it's the ad that's disapproved, not the keyword.

Dude, ive been doing PPC since Overture was launched, I'm pretty sure I know what I'm talking about. There is no ad or keyword disapproval, they simply just dont show your ad on trademarked terms 100% of the time.

What the fuck are you smoking? I bid on trademarked terms all the time. I have a campaign that's 80% trademarked terms. Trademarked terms get traffic.

Saying they don't display is one of the most retarded PPC statements I've heard all month.

EDIT: And you've been doing PPC HOW long and you've never had an ad disapproval? "There is no ad disapproval?" Jesus christ, get some experience before you start talking out of your ass.

There is a dissaproval IF you try to use trademarks in your AD COPY, yes, no shit dick head. What I am trying to tell you is that one of the niches I am in I bid on 50K plus trademark keywords, and NO they do NOT display my ad for all of those unique keywords, its hit or miss. You are the fucking idiot. Now go fuck yourself, puss!
