flame away, as long as i get some legit advice its fine, lol..

basically, did website for guy. guy's revisions took over 50% of the project, limit of 5hours (per project overview email i sent) - it took over 25 hours (no logs of it, though).

there is email back and forth about the project. I've offered him free services (before he said hes goign to sue me), i've done MORE hours than budgeted, and more items, offered free training etc. (all in the emails)

I finished his site 90%, told him i cannot complete it due to other reasons. Sent him files, db backup, froze his project with me etc. I froze it because its exceeded the limit of the project, by four times. (he sent many revisions in)

Hes offering to sue me, but for what?

No contract was ever signed or even discussed. but there is email about me getting $100 out of $500. does that count as receipt?

He asked me for my address for his attorney to send me paperwork or something, he said otherwise hes going to send it to my place of employment. (unrelated to this project, we used to work together). I told him to have his attourney call me, and left him my number - thats it.

i always thought no contract, no ammo. Just want to confirm.

Not looking for a lawyer, but advise if this is possible - or even past experience?

Edit: I really appreciate any input. I really don't think he can do anything, i just dont want the hassle of attorneys, or him bringing this to my place of employment. i'm 21, supposed to be fucking bitches..no time for this kinda dumb shit.

He wanted me to inform you that he will be sending you paperwork to [Place of employment] outlining what the case is about and what the next steps are. and what dates will be set for mediation.

You said you couldn't finish it for other reasons? what reasons are those? so its your fault that you didn't finish the website? You did agree to build him a website and if 90% is done why dont you just finish it and never deal with him again. Or since you say 90% of it is done just give him 10% of his money back.

But if you want to take the dick route and the website cost under 1,000$ you can just tell him to fuck off and sue you. Chances are he wouldn't bother.
 
the website was for $600. he paid $100 up front.

I told him he had up to 5 hours of revisions, i've put in over 20.

He has the files, DB backups, etc - which i sent to him. He's missing a fucking logo and a forum.

I actually just found this email to him from me:

"I've added notes to the project outline below, covering what has been completed, etc. This project timeline has been skewed from the revisions that go back and forth. Initially it was set to 5 hours, including logos & website. Logos take the most revision time, website comes second - Which has been taking up almost 35%(14+hours of just revisions) of the project time so far.

Nonetheless, the hours have been exceeded (a while ago @Apr 20th ish), and now that the revisions have gone past 10-15 hours (14hrs37min according to my Billable Hours Log), on top of the original 5. I really didn't look at the hours, as long as i was doing your work - but it seems that our deadlines are being blown by, and no reason presented to you. The dedicated time allocated to Revision is not included in any project time frame, the project has its time frame - and then there are Revision hours, of time spent re-doing what was already done, or needed to get done/changed. The revisions involved in this build have exceeded the limit for this project.

Which is in turn the revision times for both website and logos. Averaging almost a week and a half since the hours have exceeded their limit of 5. (Week & 1/2 on top of original project time) Again, which I had no problem not billing for the hours, and i still don't intend to - but you must understand that a) it has far exceeded its allocated limit of 5 hours for total project, and b) I wont be billing you over the limit, because it still needs to get done, and i understand the time that has been involved in the projects."

Literally tell him to suck your dick. Then if he actually takes the time and money to get an attorney, drag it out as long as you can without costing you any money then worst case you can just refund him.

this is total BS, right? i've stated in multiple emails that hes exceeded his limit and the site is 95% completed, that was 3 months ago. For him to attempt to sue me after i did all the work is retarded.

Is there way to do this without getting an attorney?


should i take his site (like 10 hits/month, LOL) down in the meantime? or not touch anything?

you do not need a lawyer fyi... you can handle it yourself... give him his 100 dollars back.. and you are done with it

this is small claims... just give him his hundred back and demand 50% up front and put a clause that this is only an estimate for that time and additional hours will cost 100 dollars each additional or whatever your rate is
 
What if he wont accept his $100 back? he attempted to pay the deposit in payments, which i accepted - because he was a friend.

I asked for his lawyers phone number, but he didn't respond. Whats my next step? wait for his lawyer to send stuff to my job? (will my employer know its a lawsuit envelope?). If i talk to his lawyer and tell him the deal, he'll know its a waste of time.
 
if he really has a laywer for 100 dollars hes a retard... the lawyer will not send you shit to your job... it will go to your home and it will be certified... or you will get an email... stop worrying about this retard

he obviously doesn't have enough money for a lawyer when hes asking for 500 dollar websites

stop communicating with him... you gave him an option... pay you in full now... or have your 100 back and never talk to me again

You're mistakes where many. Having done a bit a freelance I'll try and throw you a bone:

1) You didn't get everything down in writing first. I'm talking every little thing you need to do on the site. Every design element, every function, should generally be agreed to in advance. You can not let the client run wild on changes, especially if you're quoting a flat fee. If you where hourly that's a little different but you have feeding yourself to think about.

2) You continued to work long past your quoted time. The sooner you cut off the client and try to renegotiate on a price, or drop the project, the better. If there was an amount of time agreed upon and you just kept going for a few times what you where suppose to why shouldn't you finish? You already made it clear that you had intended to put up with his crap and see it though. Despite not making any more on it.

3) You did work for a friend. Nuff said.

Overall it sounds like he owes you for the original quote for work rendered whether or not it was completely finished. Generally these type of situations are cause by pure lack of communication with your client. That's not to say you just suck at what you do, or you dick off too much, or play too much WoW, that I do not know. However in my experience as long as you keep a good flow of communication with your clients, give them a heads up, shit like this will not happen except in very rare circumstances. You may have played too much mister nice guy and got screwed, or maybe you're just a lazy fuck who fucked a client over, I don't know. Anyways best of luck the next time, use your head.

Also he's only out $100 and has your work (which was dumb) so yeah not going to be worth the lawyer costs IMHO.
 
I wouldn't worry about this. You both voided your contract.. I don't understand why you didn't have an agreement about the change orders ie... what happens after your allotted 5 hours (this is standard stuff and how most guys make a living by charging for the revisions) I wouldn't give him nothing more than a bill.

No attorney will touch a case for a $500 contract so that's bullshit. Worst case scenario he goes down to the courthouse and files small claims paper work (he wont he's far to lazy or stupid for that) but if he does you go and the judge laughs it off (or you counter sue before the court date just to fuck with him) and that's about it. End of case never talk to each other again and move on with life.
