My big question is...

Are you allowed to talk shit about your competitors?

That about sums it up...
I have posted this question on a legal board, but after nearly a week, gotten no replies.

I am asking because I discuss how my competitors products are defeated/bypassed/rendered useless (automotive security products)

I would also like to show how some of this is done in on camera.

Anyone know if I can be sued for this?

I see it as May the better man win...

But the law might not.
 


yes, you're allowed some limited use of trademarks for journalism/criticism...

it's fair use... sites like paypalsucks.com and others are constitutionally protected free speech...

now, keep in mind that just because you have the RIGHT to do it doesn't mean you won't get in a bit of trouble... you may still get a C&D and/or lawsuit depending on how you go about it or who you attack...

proceed with caution... my 2 cents...

Use of a competitor's trademark or product in comparison advertising is generally allowed.

In regards to saying anything negative about your competitors product, you need to make absolutely certain that your statements are true, correct and not misleading. It's generally better to make positive statements (also absolutely true) about your own product and let the consumer draw their own conclusions.

The demo should be OK as well, as long as everything you show is, once again, absloutely true and correct. For instance, if you were going to demonstrate opening a Kryptonite lock with a bic pen, you have to actually open the lock with the pen without previously tampering with it, in order to make it appear as if you're opening the lock with a bic pen.

In other words, everything you say and do needs to be demonstratable and defensible.

Everything I say is well researched and tested, and I wont say it unless I can do it myself. Same goes for demonstration. I would show step by step how it's done...

I know that could have its own issues, but that is a whole other topic...
