Blueair air purifiers and cleaners contacts ebayer who has one of their products listed, telling them they need to take down the listing since it's advertised at a lower price than what their partners are allowed to sell it for..

You're correct, I am not an authorized dealer. I'm just an end user that doesn't need their air purifier like they had thought. If your company would like to purchase the item from me for full price that would be great. I need some extra cash!

So this company wants me to be stuck with this item, and to not sell it now that I have a built in the wall air purifier unit? (Went with AmericanStandard that piggy backs on my new AC unit)

so what would happen if, hypothetically, the ebayer was buying them from china directly from the manufacturer, and selling them on ebay?

100% identical product, same packaging, everything identical just as if they bought it from walmart.
 
Well they prob have an exclusive contract. More than likely you would be buying knock offs, even if they came from same factory. Then they could go to feebay and file a counterfeit grievance. Look at some of the designer jeans. They yank listings or ban newer accounts if you try selling them (even if they are legit)
 
If you are selling them over and over for a profit as a business, then yes that is a problem as it violates their MAP pricing. But, if you are selling one of them because you don't want it anymore, then they can go fuck themselves.

I dealt with MAP pricing shit for years and it really boils down to how the individual company enforces it. If you are buying wholesale and selling on eBay, then they should contact your wholesaler.
 
inb4 OP admits he's been doing amazon ebay arbitrage with these purifiers for 6 months now.

Lawyer just spoke with her personally.

She is going to forward him an email that outlines the resolution of the issues. She claims that she demanded the removal of photograph that I was using, from their website. She claims the violation was for using the copyright of the photo, not trying to sell the product. Obviously that was BS given the fact that she talks about authorized and unauthorized vendors. She says she will no longer bother me, etc.

Email should be coming soon.

Well, it's perfectly reasonable for them not to allow people to use their images without permission.

Awesome. A valuable lesson was learned here today. Let's rehash for those with the attention span of a gnat:

1. Seller tries to sell 1 Blueair air purifier on ebay.

2. Blueair's owner gets pissy and says "Take that down now; it'll hurt our authorized resellers! We're a small international corporation!"

3. Instead of waiting for a C&D, the SELLER goes on the offensive and has their lawyer send Blueair a threatening letters saying 'the law is on our side, you dumb shit. Apologize now.'

4. Blueair shits their pants and changes the focus of their complaint from reselling to photo theft... And then basically says "no biggie, it's cool now."​


Gotta remember that tactic. Good stuff. :thumbsup:
