Hi, I'm wondering what actions would be taken against me if I was caught having copyright content (movies and episodes) hosted on my server.

Would I just have to take it down?
Will they sue me?

I also live in New Zealand if that makes a difference

EDIT: I'm also a minor, only 14 :)

Well first off it is obviously illegal, you should check out some of the laws in New Zealand, I'm not talking about local law I'm talking about Internet Law, you don't have to spend any money just read up on it or think of a good related question to ask a lawyer (no need to book an appointment, if you know one or know where one will be go see them).

If its your own server they cannot shut you down unless your breaking your own countries Internet Laws, or doing something dumb like child pornography, then they will hunt you down across countries, look at Warez sites they get away with it (not sure which country their hosted in) but lets take Greece for example Zero internet laws so they technically cannot shut you down.

If you get to be super major then you'll be targeted forsure, the hollywood movie maker industry will find you when your popular and if they know of a loophole or something similar they will destroy you and fine you BIG time.

It could be a dangerous move if you do it and most of the time its not worth it but if you do your background checks on your own countries Internet Laws and are pretty much certain you cannot be touched then fuck yeah dude go for hit, hit that shit up.

P.S. I could care less if your 14, if you come through then your good in my books haha.

There is one way to get away with violating copyright law: thats the DMCA, and it applies in the US. What the DMCA does is remove liability from an ISP for content users have uploaded as long as they respond to removal requests in a timely manner. This is why you can get pretty much anything off YouTube.

In terms of Warez and hosting your own stuff, you bet you can get in trouble. That includes prison time as well as having a criminal record. Even the guys involved with ripping and posting movies, software, etc, never host it themselves. They look for unsecured FTP sites and upload the files there. There are also a lot of these free file upload sites now. I can't think of any names but they usually allow 100mb+ files.

I don't know about New Zealand, but in the US they've passed some pretty wild laws specifically protecting unreleased movies and you can do hard time now for just sharing a file on P2P..

Same holds true for canada, its not only with movies its with the music industry, they have not yet started to go after the small time guy (sharing under 500 files or so) but I remember one story about a medium income family that was being sued for half a million bucks by the music industry because their under age son (15 years old) was sharing 10,000+ music files on a P2P network.

Thanks, I'll look into the New Zealand law and I might just stick with uploading to DailyMotion and RapidShare.
But I'll keep looking into the New Zealand law, and whether I'd be able to just get a server in those countries the big torrent sites are hosted in (Sweden I think).

Also, if I were a filehost I could just pass of the illegal content as being uploaded by other users right, and comply when they want stuff taken down?

Thanks again.

It doesn't quiet work that way, they will target you and not the user uploading the file, the reason why is because your the #1 cause of it, why take down one person when you can disable thousands by going after you.

There tricky in this area and you've got to remember these industry dogs have got money to through around and they've got the top lawyers who know the law forward and backwards.

Obviously you missed the point. You *can't* be the uploader. Sure, your under age so its your parents who are going to end up getting fucked more than you.
