such fucking bullshit. the animal stuff is def obscene but 2g1c style stuff is not.

This is what happens when religious conservative groups pressure the DoJ. complete waste of resources and tax payer money.

It was heavyt and cakefarts who made it into a big deal.

The original video was from a Brazilian porno, and I'm pretty sure the producer for that (unrelated to heavyt and cakefarts) is the guy whose in trouble.

Also why is he getting sentenced to 4 years? Aren't these sorts of videos protected by the First Amendment?

Maybe it can be interpreted that way, but the First Amendment is from the 1700s; they probably would have hanged the guy back then.

What they consider obscene now might be different than years ago, but still as recent as 2005 the Bush administration felt a need to create the Obscenity Prosecution Task Force, which helped sentence Max Hardcore to 4 years in jail. In the 1990s comic book artist Mike Diana served jail time. These are just a few examples of convictions.

Except it wasn't physically filmed or distributed ... in the US? I don't believe?
 
Does it still legally and technically count as obscene if it was all fake and pure theatrics / props etc?

Obviously it would if it were in an Islamic country, but what about the states?

Yes, it can still count. At times, certain written books and comic book drawings have been defined as obscene by US courts. A rap album by 2 Live Crew was once deemed obscene, though that was eventually overturned by a higher court.
