The future of the fledgling industry—estimated at $100 million in annual sales and rising—may hinge on the outcome of a case scheduled for oral arguments before a federal appellate court in Washington, D.C., next month. The FDA is fighting to regulate the products as drug-delivery devices, similar to nicotine gums, patches or other nicotine-replacement products. Such a classification would subject e-cigarettes to lengthy and expensive trials to prove they are safe and effective.

Yes, just about 99% of them do. I've only seen one brand selling them with no nicotine.
 
they are trying to categorize it into drug delivery service means this device carries nicotine supplements which either require them a special license or something and also they will regulated under FDA which means more scrutiny
 
yeah, i'm sure big tobacco has zero problem with this growing to affect their business.

Actually, it's the e-liquid that contains the nicotine. And you can buy juice without it.

I really don't see how it's legal to regulate the device in and of itself (without the liquid). If that's the case then they should also regulate water bongs and bowls.

yes agree on that, it's the liquid that's the issue, not the device.

though most manufacturers are selling both together as 'kits' - quite a bit different than walking into a headshop and picking up a piece of glass which comes with, well, just the piece of glass.
