Can anyone recommend a good course of action when the FTC wants to rape?

I have contacted an attorney that specializes in this sort of thing but he wants a huge retainer. I just want to make sure I'm doing the right thing.

Has anyone had to deal with the commission, and emerged alive? What sort of fine rapeage can one expect?

p.s. disclaimers on farticles don't mean jack shit

the nice man at the FTC just called me today and said that they are filing an injunction against me on Friday for "false advertising and deceptive business practices". I had all the disclaimers and guidelines in place and they are still coming after me. Anyone running a farticle/fake news site for any extended length of time on any large ad network should beware.

Also doesn't make sense because the FTC almost always goes after the advertisers, not publishers.

Even when it comes to fake news sites, they have tended to go after the advertisers who allow and/or encourage pubs to promote their offers this way, they rarely if ever go after the pubs themselves. Especially low volume pubs.

How much is a "huge" retainer? If you can afford it and he is the best attorney for the job then you might as well do it because chances are if you have the money for it and choose not to that money is going to be gone after this anyway.

Sucks bro. Do they only want an injunction or are they coming after you with charges?

edit - my question seems really dumb. The fact that I can't answer it myself leads me to think you should seek a qualified attorney. This is a cost of business, a shitty one, but I don't know what else to say.
 
what niche? sometimes its hard for someone to prove its false... for example bizop... most likely u will settle outside of court... they just want their cut

edit: did you have a lawyer write your disclaimer or did you just make it up (or copy) I wouldnt think a disclaimer would guard a page littered with false info anyways... but just curious

and if any of you think private whois is hard to crack thats a joke... ive had to send about 5 - 10 dmca's and c&d's and they whois was blocked on all of them... the 1.99 you pay a year is a joke... ( about half were "smart" "big" affiliates that would never copy ;))
 
I think it's clear to most that whois guard is just a simple protection from all the regular schmucks you don't want hatemail and angry calls from. When it comes to more important issues like suits, c&d's, the works, time has shown it matters precisely squat if you have whois protection enabled

Last night the news ran a story on all the "acai berry fake news sites" and how the FTC is going after a man in the Seattle region that supposedly is responsible for the majority of them lately.
