How the hell are they going to police this?

protecting consumers from themselves is a waste of time and money

The Federal Trade Commission is going after bloggers, celebrities and tall tales in the first revision of its rules for endorsements and product reviews in nearly 30 years.
The FTC isn't changing the law they are simply changing what they view as best practices, they would still need to win in court based on existing law which to my knowledge hasn't changed recently.

So your best practice would be to avoid things like farticles and flogs, but they aren't any more (il)legal now than they were 6 months ago.
 
Somebody should take that "FTC approved" logo I've been seeing in another thread and put it to use to make a FTC style endorsed LP. Muhahaha
