maybe they could host the images offshore such as china where they really won't respond to pleas by lawyers to shut down the hosting...

I love it! From the article:

Senior legal executive at PPA, explained: “They’ve made themselves as difficult as possible to get hold of. It’s a case of smoke and mirrors – the website operator is registered in Anguilla in the Caribbean but the ISP, which we think may be hosting it, is based in the US. The main priority is to get the offending content off the website.”
Evans said: The website’s terms and conditions have tried to make it so the users are liable for the content.

Nah. The future of these types of sites is very dim.

Youtube only survives because G pays the copyright holders off. Copyright laws are becoming more and more liberal and are progressing to more and more countries.

This site clearly breaks US copyright case, which has already established that a provider's primary intent cannot be to encourage its users to share copyrighted materials. The name of this site alone is enough to incriminate the owners.

Sure, it's located in another country, but it's only a matter of time before treaties are made. This site would have done better 5 years ago before the Internet began maturing and being policed. Now, it only a matter of time.

what about magazines that are no longer for sale? cant be anythign wrong with uploading them...

No matter what there will be legal issues, even if a magazine is discontinued the owner will still want a royalty for users who download it, its the same with music/movies aneverything else...

I've seen entire textbooks scanned before, I'm pretty sure there's people out there who are willing to upload some magazines.

It's actually quite easy. Simply bandsaw off the book's binding and run it through a scanner. You guys need to realize that there are scanners out there that operate at 2 pages per second duplex and have a maintenance cycle of 250K pages. I can scan your 1500pg calculus book in about 10 minutes in 200 DPI.
