So for a while now I've been pushing ringtone's using song samples ( mp3's I own) with artist pics for LPs... I'm wondering if anyone could point me in the direction of possible legal issues I might have here...

Again, I purchased copies of these mp3's and can prove that in court of law... I'm just wondering about the artist images... I noticed a long time ago shoe totally rebuilt nextpimp and took down the downloads section etc...

also, I won't be clicking any links posted for fear of getting dickrolled @ work..

you mean you purchased RIGHTS to the song, likely on itunes or similar, for PERSONAL non-commercial use?

If so I would *assume* there goes your argument in regards to using those.
 
Even if you purchase the mp3 from lets say Itunes it still gives you no rights to use it for commercial use unless you went and licensed it through BMI, ASCAP, etc. As far as images, they are owned by the artists and usually the record label has a lot of say-so as well so you would like always have to get full written consent (which isn't going to happen).

You don't buy 99 cent songs to use for advertising ringtones>YOU LICENSE the use from ASCAP/BMI!

The smartest thing for you to do is to use the data feeds from companies like Dada, Jamster, Thumbplay so that you aren't doing anything but linking to their already LICENSED mp3 samples and images.

Of course, if you link to them you'd better be actually promoting their offers.

Seriously though, WTF were you thinkin - Did you honestly think you could resell a .99 song you purchased online. You don't have any licensing rights dumdum.

^I am not reselling the songs. The LP simply plays a sample of the song and when clicked redirects to the affiliate offer. No where did I say I was selling anything, or allowing for the download of anything.

That's pretty much the same thing if you are using them to get people to click thru to affiliate offers, where you get paid.
 
You can't legally use the clip on your landing page.

Try embedding a clip from a legit licensed service, for example: search on Google for the song & see if there is a 30-second sample from ilike.com (such as MySpace Player ) - embed that page in an iframe & it'll probably work.

You still can not legally do that asshole...You are using the likeness of a band/artist, as well as their music/properties in order to get someone to click-thru to your offer, where you make money and the artist/band doesn't get compensated.

So if we are following that logic, you are in fact making a profit from properties of which you haven't paid the licensing fees to use via ASCAP/BMI

So you are in fact reselling, indirectly.

Lol the songs are for your own personal use and to listen to. You can't use them commercially.
