A 13-year-old girl claims another girl and her mother assaulted her and that the mother recorded the entire incident with her cellphone.
On Wednesday June 9th, two 13-year-old girls walked to Deer Park to fight. When Miranda Gomez left, she was bruised and battered. Her mother Kathy rushed her to the hospital later that night.
"If it would have been two little girls having a fight, no problem. It happens. But it was much more than that," said Kathy Gomez.
The fight was over a boy. According to Miranda Gomez, the other girl's mother, 29-year-old Jennifer Alarcon, showed up during the fight and started recording the entire incident with her cell phone camera.
"She was talking in to (the cell phone). She was like this is Miranda Gomez the white trash. My daughter is going to beat her up," said Gomez.
Gomez also claims the mother eventually joined the fight.
"I remember that she was beating my head and then I felt something. I don't know what it was but I knew her mom was standing there and I felt her legs just like holding me down."
Two weeks later law enforcement executed a search warrant at Alarcon's home, looking for the cell phone that was allegedly used to record the fight.
According to the search warrant obtained by Channel Six News, police seized 6 cell phones, gang paraphernalia, a computer and a small amount of marijuana.
Channel Six reporter Justin Joseph spoke with Alarcon at her home Tuesday. Alarcon declined to appear on camera but told Joseph this only happened because her daughter is pretty.
Alarcon also denied holding Miranda Gomez down.
"I'm 400 pounds. She's 93 pounds. If I would have held her down she would not have walked away," said Alarcon.
Alarcon admits she did shoot a little video but says she did not record the actual fight. She says he only recorded 5-seconds of video.
That cell phone may now contain the best evidence of what happened at the park that day. Tuesday City Prosecutor Marty Conboy says his office was still reviewing the cell phone evidence to see which recordings were on them.
Alarcon has been charged with Disturbing the Peace, Disorderly Conduct, Contributing to the Delinquency of a Minor, and Caretaker Neglect. Alarcon was not charged with assault.
The parties will be in court on Wednesday, July 14 to argue over a restraining order filed for the protection of Miranda Gomez by her parents.
