Just venting a bit...
A few months ago the boy friend, Kay, of a good friend the family needed help getting an ecommerce site with some specific functionality off the ground. I was extremely busy at the time so I connected Kay with another friend of mine, Dick, who is a developer. They signed a contract that had specific milestones and payments attached to them.

For the most part I was not involved in this other than making the connection and giving my input on designs and features. This was back in December.

Can you guess where this is going yet?

About a month ago Dick said that items he thought were completed by his partner were not only not complete – the code he wrote was not usable. So Dick said he would start from scratch. At that time he estimated that he could get the initial front end up in about a week.
For the last 3 weeks we’ve been hearing that he has a few more hours and its done.

Now Kay is really pissed about this as he had some national TV exposure for free 2 weeks ago, but no site.

"Another few hours and we are done" for the last 2 weeks

This morning we get an email from Dick saying that he is going through some personal issues, is overly stressed and accidently overwrote his files. As a result he is giving up on the contract that he was already paid for.

They both asked me to take over development, to which I tentatively agreed. I sent Dick a contract for it which also included paying me all the money he collected by credit card so that I would be paid immediately. Now he comes back and says the best he can do is 1/2 at the end of this month and 1/2 the end of next month. If I take it its basically all my free time and my next 2 weekends to get it dome

Now I could just tell Kay that I don’t have time. But I don’t want to leave him hanging and its good money (if I can get it).
I have to see if I want to accept that payment plan from Dick.

(Both name have been changed)

PS: why are you telling us this before you've even concluded the business? Does "Dick" or "Kay" stroll around WF?
I guess it's akin to saying "hey, wana see how he talks about clients, check out these threads."

No, neither of them are here. Just me venting a bit

On the other side, Kay does have a solid plan once the site is up, so I may make part of the deal be a % of the sales or company

Isn't what you described basicly how every web design deal ends up? :)

I'd say, if you think your buddy is competent, that the clients may be difficult to work with. (Otherwise why couldn't the work just be completed?)

Is this possible or am I way off base? I have a bad taste for doing web work for others, sorry..

I've been on both sides (as a client and developer)

This is one of the cases where the develper was at fault. He was claming that there were just a few more hours of work, and then turned the whole thong over saying he could not complete it.

You need to charge Dick that if you go by his terms it will cost him more - $200 per month. Otherwise he can pay upfront.
