Senators to Unveil the ‘Ex-Patriot Act’ to Respond to Facebook’s Saverin’s Tax ‘Scheme’ - ABC News

Sen. Chuck Schumer, D-N.Y., has a status update for Facebook co-founder Eduardo Saverin: Stop attempting to dodge your taxes by renouncing your U.S. citizenship or never come to back to the U.S. again.

In September 2011, Saverin relinquished his U.S. citizenship before the company announced its planned initial public offering of stock, which will debut this week. The move was likely a financial one, as he owns an estimated 4 percent of Facebook and stands to make $4 billion when the company goes public. Saverin would reap the benefit of tax savings by becoming a permanent resident of Singapore, which levies no capital gains taxes.

At a news conference this morning, Sens. Schumer and Bob Casey, D-Pa., will unveil the “Ex-PATRIOT” – “Expatriation Prevention by Abolishing Tax-Related Incentives for Offshore Tenancy” – Act to respond directly to Saverin’s move, which they dub a “scheme” that would “help him duck up to $67 million in taxes.”

The senators will call Saverin’s move an “outrage” and will outline their plan to re-impose taxes on expatriates like Saverin even after they flee the United States and take up residence in a foreign country. Their proposal would also impose a mandatory 30 percent tax on the capital gains of anybody who renounces their U.S. citizenship.

The plan would bar individuals like Saverin from ever reentering the United States again.

“Eduardo recently found it more practical to become a resident of Singapore since he plans to live there for an indefinite period of time,” Tom Goodman, Saverin’s spokesman, told Bloomberg News in an email.

Last year 1,700 people renounced their U.S. citizenship.
 


So he leaves the country. Renounces his citizenship last year. Senator tells him (now, as in recently told him - not last year when he renounced) to stop trying to dodge taxes.

I dunno about this kind of thing. He didn't renounce his citizenship until just 6 months ago. In most other scenarios if you did something premeditated 6 months before knowing you would have a large windfall so you didn't have to share that money with whoever was legally entitled to it, it would be pretty cut and dry.

More importantly, why does someone who's about to make 3.5 BILLION give a shit about $67 million in taxes??

Capital controls are coming boys. Saverin is the poster boy that will kick of all manner of new laws designed to prevent money leaving. Already we have FBAR. Then FATCA goes into effect January 2013. Now we have this proposal to ban people who renounce and confiscate a huge chunk of their money. Next will be controls and confiscation for people who simply expatriate without renouncing.

Lukep and anybody else thinking of expatriating, better get your money out sooner rather than later.
 
Closing the loophole and making sure he pays the full capital gains tax is fine, trying to tax him for years after the fact as well as banning him from the U.S. is a little extreme imo.

The problem is the money has to pass through U.S. banks to reach Eduardo. One call by the right government official and all his U.S. assets can be frozen.

FBAR and FATCA are existing laws. There is also an existing exit tax that is enforced if the IRS determines you are renouncing to avoid taxes - they treat all your assets as if you sold them on the day you renounce and you must pay capital gains even if you did not sell any. Confiscatory in the extreme. This already exists.

Now this grandstanding about banning renouncers is now out there. Sure, it's speculation that something like this would pass, and that more will follow. By then it's too late.

I'm not going to argue whether or not the IRS is entitled to collect taxes, but yes, as a US citizen he is legally obligated to pay taxes according to the US tax code, just like the rest of us US citizens.

Benefiting from the US in a big way and then trying to not pay taxes you legally owe is pretty lame.

No one likes paying taxes, but rules are rules. If he didn't want to pay a big tax bill when he struck gold he should have stayed in fucking Brazil and tried to create a Facebook there.

Seriously. You don't think there's anything wrong with him becoming a US citizen in 1998, making 3.5 billion dollars over the next 14 or so years, and then giving up his citizenship just before he's about to cash in to try to avoid paying taxes on that money? Seriously?? Seriously????

He's not trying to take his money out without paying taxes... He simply renounced his citizenship before the IPO. It is TOTALLY legal for him to do so.
