Now this aint about Oprah, so dont even go there sista

But as I understand you can buy paparazzi photos celebs for your 'blog' for about $5 a pop and have the legal right to use these as 'editorial' content.

I suppose, can someone advise, where is the line between editorial and advertising content.

ie. . can I just do a big ole flog about anti-aging and then have a picture of demi moore (that I own the rights to) in the sidebar?

not that she is directly endorsing the product, but her picture just happens to be on the same page?

someone follow and can offer input?
 


Nah. No need to buy it. Because, You will see all news papers / websites etc etc will use the same picture and they dont buy it, they just see a picture and use it.

Well not really because you can just say Prove it , and if they dont have proof its a closed case

Here in the UK , BBC and Sky and the rest of um just use sources from each other , doesnt matter who owns it or who took it. Most of the time they dont even include who took the pic

...or you could host your website in some foreign country where there's no US jurisdiction and you're protected from any/every legal action...

What he described would be a civil, not a criminal issue. There would be no penetration.
 
Not Worth It

Fair Use Doctrine doesn't apply when an image is used for commercial (non-editorial) purposes. Translation: If you are using their pic to make people think someone more famous than you endorses your product/CPA offer/flog, you're asking for trouble.
 
Newspapers dont just use images. They buy rights for everything or get a blanket order from someone like Getty images. Go to CNN.com every image is Getty images.

Ever know anyone that got a letter from Getty? I have. It is not pretty at $1500 a picture.

Getty uses a company called picscout that bots the web, captures images, takes them to their server and compares them to ALL their clients pictures like Getty Corbis etc. Just another reason for anonymous registration and no real contact info on a site.

Not that they have any real leg to stand on but using any image you dont have rights for is risky. I used to think Fair use applied if more than 50% of the content is original. Now I am not so sure.
 
I was actually just reading the TOS on istockphotos and they also say you cant use their photos to imply that the person in the photo actually endorses any sort of product or business.
