I'm seeing more and more video gaming tutorials being made purely to promote Adsense. Isn't this a violation of the Adsense TOS as you don't actually own the footage you are applying the ads over.

The reason I'm asking is because Google have always banhammered anyone pretty quickly for infringing TOS on their own websites but it seems like more and more "gamers" are producing guide videos but plastering them with fucking Adsense (I use Adblock but often disable to check if the video has ads).

And no.. it's not the developer placing the ads on the videos much like happens with music videos.

I make some video game commentary and tutorials of which some get 5k-10k views and Youtube seem to be getting really relaxed in regards to it but I'm not willing to risk my Adsense account (quite established at this point) getting banned.
 


Probably not an issue since most all video game companies don't care about youtube footage after a game is released. Most actually see it as promotion for the game, and rightly so.
 
Tons of video game reviewers/competitors are Youtube partners, so it's probably an exception to that rule.
 
I'm not talking about partners who can do w/e the fuck they want and it's a given most gaming companies are OK with people using their IP in videos and on websites. I'm referring to the major increase in the average person who gets the monetisation alert and starts putting it on all their video game footage and the Google TOS (not the developers).

"Probably not an issue", ""probably an exception to that rule." and quoting the obvious doesn't answer the question.

Is this falling under fair use or is it simply something Google ignores and only acts upon when receiving a complaint. The Google Adsense forum is full of similar questions but there doesn't seem to be a clear answer which I'd want before going down that path.
