So I sold a site of mine a month or so back for a few K and I think the guy died because he won't call me back, hasn't been on to the site I sold it from since the transaction (was a regular visitor) and won't respond to email.

The site I sold him is sitting on his server with an error since he doesn't have PHP parse as .html (simple CPanel fix which I told him about). So he is blowing several hundred a month in passive income, so I figure something is messed up...

I've tried contacting him to see what's up, but like I said, I think he's dead.

Q's:
1) Is it possible to get the domain back?
2) Is it unethical to take the content and design from old site with a new domain and arbitrage it?

What would you do...

I know what I will be doing, but want others opinions. I'll share what I am doing in a day or so.

Also, someone answer Q #1, any sneaky ways of getting this domain back???

I can't help you get your domain back, but my friend once sold a Mustang on Ebay. The guy paid for the car and never came to pick it up. My friend left several messages and even wrote a certified letter stating if he didn't come pick up the car it was going to be sold again... Which it did. Never heard from the guy.

This is different from your situation because you actually delivered the sold item to the buyer. If you want to stay on the happy side of the law I'd say forget about it.

Thing is, this guy took a month of due dilligence for such a small site, almost relisted it.
