This is from an XY7 press release I picked up on today... Pretty good news actually. Some people may give XY7 a hard time, but say what you like, Kevin is a really good guy and he and his team have always done right by me. Glad to see they stood up to this bully (I think he's still a member here) and won.

Dan Balsam is known all over the industry as the guy who stands in a trench coat in the corner at some big industry conference like ad:tech SF or ad:tech NY and then as soon as the doors for the show open, as fast as his little gremlin legs can carry him, makes his rounds serving networks with lawsuits, knowing full well that they have always just settled with him. That settlement = his only source of income.

He's a member here too, and I remember his reason for doing what he does is "to stand up and defend the rights of consumers" -- how he manages to do that is beyond all of us I bet, because he's never "given back" the way he promised so many times he would.

But hey, at the end of the day I could really care less if he makes his living this way or another, because I'm not a network and to be honest he's never been mean to me for any reason either. So I'll just give him the benefit of the doubt and say "sure, awesome job, you just got pwned by Kevin over at XY7, now what?"

Kudos to XY7 for fighting the guy and not settling like everyone else always does. Hopefully more networks will follow your lead on this.

We've watched for years as Dan Balsam (danhatesspam.com) sued frivolously for unsubstantiated "SPAM". Dan, a Berkley Law graduate, ambushes companies in small claims court where lawyers are not allowed leaving upstanding legitimate corporations with their pants down.



Dan sued XY7, XY7 fought back!



XY7 sent CEO Kevin DeVincenzi, Directer of Operations Ken Graham and email marketing expert Adam Young to defend the rights of marketers.



Justice prevailed and the case was dismissed!



XY7 will never let someone abuse us or any of our affiliates with frivolous law suits.
