It isn't that they're despicable, they just have shady business practices...some have accused them of affiliate link stealing, but what worries me most is the almost-spywareness of it.

ALMOST? Dude, Zango IS spyware. It's the very definition of spyware a program bundled and installed without your consent that monitors your activity.

They used to do that, they got in trouble with the FTC because affiliates were bundling the software and not running the TOS upon installation. What Zango actually is, is adware. Advertisers buy keywords and urls from Zango and is displays pop-overs based on what who bids the most money.

Spyware, whoop-de-fucking-do. What do you think Alexa toolbar does? Or Google's? All *spyware*, they record data and send it back to the companies servers. Google even admits that it will keep personal user data at least 14 months, if not longer. As for spyware that steals your passwords and credit card information, thats a whole different category -- which Zango certainly is not, nor is Google or Alexa.

Technically, as long as there is a disclaimer stating exactly what is being installed during the installation, and the user clicks 'I agree' or checks the '3rd party programs' button, it's not spyware. It would be adware.

Spyware is installed without the user's permission and displays ads or keeps tracking of user habits/history either to find trends or to display relevant ads.

If it is malicious, it is called malware. Malware installs itself without the user's knowledge. Viruses, trojans (RATs etc), keyloggers, IRC bot software, spam software, and rootkits are all considered malware.

Most people confuse adware and spyware, but most people really don't care what the technicalities are. As far as they are concerned, it's all spyware, because they wanted a screensaver and they end up getting popups along with it. Nobody reads the disclaimers or fine print, but being that it's there, it's completely legal and nothing can be done about it. If it's not, Zango, or anyone else in the US would be in trouble.
 
zango used to steal our affiliate commissions plain and simple, you got some balls defending them andrew. you woulda been lynched here a few months ago if you posted that before the huggy happy wf 2.0 :) i still love you tho
 
That's not a bad idea chatmasta. I don't think it looks bad. Just a small banner across the top, a mouseover caption, small menu button that's barely visible and your logo. Sounds like a shitload of stuff crowding the pic, but it's not.

May have to play around with it a bit.

Have you tried CPA, that is normally quite a good area to look as some of them have screensaver and icon type offers and where anyones looking for wallpaper they also may be interested in that sort of stuff also. Just a thought.
