Does anyone here have any experience in selling intellectual property. Specifically Trademarks. Know of any good websites/resources to auction/value them?
 


The value of IP rests COMPLETELY in the eyes of a purchaser. You can set a price but two different potential buyers might pay WILDLY different prices.

The exception of course is with well established brands that are publicly traded and have an objective way to measure the price.

I happen to snag the trademark on a well established company and they have no idea. But before I try to sell them the trademark, I need to get an idea of what im looking at charging for it.
 
Ummm... you know a trademark doesn't need to be registered right?

If you're not actively using it, you got nothing...

Define "actively"

I have business cards, Shirts, keychains, and ive already made 3 sales in the same industry. I would like to have the domain but they have it. Do I have the right to tell them to stop using it since I own the trademark?

Who has been in business first? If they have, then you have no case.

Yeah they've been in business before me. So let me get this straight. They dont need to own the trademark to own the name? But if I wanted to continue selling my product under the same brand name, I could do so without worry that they would sue me. Since I own the trademark?

They can sue you for the trademark rights.
 
Talk to a lawyer, none of these asshats have a law degree or any clue what they are talking about.

It's gonna be a tough case, since the original company didn't register for it.

Dude you're getting legal advice from people on a forum. Just pick up the phone and call a trademark lawyer.

Both are right. Any legal advice given on these threads should be taken very lightly.
