FB makes the law? I'm not sure how analyzing the incoming traffic then redirecting accordingly is illegal. Is georedirecting illegal in FB law also?

No, but by declaring it in their terms and conditions, and by you creating something that violates those terms and conditions, you open yourself up to having charges pressed against you if you don't comply with their requests. Hence why MadPPC pulled everything.
 
I think the problem here is that you're confusing TOS with actual laws. My script isn't connecting to Facebook. Prosper gives users the ability to break TOS just by swapping links. Are they after them?

Props for actually understanding the law. I suggest not using the word "Facebook" anywhere in the product and promo to have even less alleged liability exposure. You can simply promote it as a general-purpose cloaker that can work with Facebook, just like any other ad network.

BUT - if you don't use the words like "facebook" "facebookads" "fbcloaker" when describing your product and don't talk about using it to cloak facebook and just name it a generic cloaker that would work on every ad platform, then you *might* be safe from legal trouble...

Also, try asking this guy to see if he can help you make it in a way that would save you from legal trouble.

I say you change "FB" to something like "DC" that way you'll be totally safe, and since we already know what youre talking about it'll be our little secret code.
 
As someone mentioned that's one reason I was sent a C&D just don't refer to Facebook in any capacity.
 
Looks pretty cool. How's the list collected? ARIN seems to be working 100% perfect for my users (and myself, I've got a few FB campaigns really just bringin' it home)

Let's see, your targeting Facebook marketers, so I'd say yes. Well at least that's how the community would see it, any old lamo probably wouldn't know the difference.

My advice is simply:

  1. Just drop the FB part of it.
  2. Come up with a different name.
  3. Profit.
Although I'm not sure how much of legal leg they have to stand on if it uses 'FB'. I'm just saying the small change will save you from any hassles down the line. I'm not a lawyer so WTF do I know?

All I know is that if company A has much more money than B, and B really pisses A off, B can easily end up in trouble. I would stay away from anything facebook related in the naming.


On other note, I'm not big on FB, but what you say just doesn't make sense to me. If it works, why releasing it? IMO just by releasing it, you will kill it (I mean FB will).

This thread has got me thinking and I've decided that anyone who signs up for the list from this thread will get an invite when it's released and then after that there will be no further promotion and it will go completely private.
 
Your IP list means shit..FB now uses proxies to check your ads. No wonder you are selling this shit now.

Can you explain why my purely-registered-IP-based-cloaking isn't getting my accounts banned then? PM me if you want to hear more about what I'm doing, as I don't really want to post it here.
 
No, you could easily monitor the script to verify it's not communicating with anything it's not supposed to be. All campaign data is stored on your servers.

Ok so buy it with your own money, pay to crack it, then give it away to your competition. Great plan.
