Setting up a PPV email optin WITHOUT aweber

Ok, so I have my basic email optin script using a basic email collector lp that I designed. I am driving traffic to my LP via trafficvance. I have the emails saved into my database in a program that I coded in PHP. So far, everything works great. I got so ahead of myself, I forgot to think about the legality of this. I have a few questions:

1. Since they input their email, that counts as an opt-in right? Do I need to send them a confirmation email legally?

2. I don't have money to afford aweber right now, but I am a decent coder. Can I just code up a script in PHP to mail to them since they opt-ed in and track conversions using something like prosper?

The problem with what you're proposing on doing not using an optin service is the battle with delivery. Aweber have excellent ip rep, so it's almost guaranteed to inbox granted your copy isn't blantantly spammy. The way you're doing it is going to cause you a shitload of hassle to inbox unless you have some awesome connections or ip rep, and that kind of stuff costs a whole lot more than those optin services.

aweber allows you to single opt in, you just have to select it in the options.
 
Aweber will allow single opt-in as part of the setup . (or at least it did 6 months ago, have not been using it much lately).

If your spam complaints get to high, they will force you to double opt-in - if it stays crappy, they will shut down your account.

GetResponse has an API you can post the names into. I have used them in the past - deliverability was not as good as aweber, but a good option for self generated names.
 
What you could do is offer some incentive for joining your list, and have the confirm link page link to your incentive, ie have it set up so that the only way they can get your incentive is if they opt in, but do it sneaky.

Cool, I've never heard of them. Thank you. As far as you know, if I sign up for say the 10,000 plan, can I go ahead and split those up into different lists (say I have an opt-in for PS3 fans, and another one for xobx 360 fans)

I've been using Godaddy's email newsletter service for a couple of years. It get's the job done and only costs $59 a year or 50,000 emails, whichever comes first.

True, it really depends on how your mailer is setup, and whether your ip's are on any blacklists. I do know several people that inbox fine, using their own servers. But again it all depends on how your marketing, if you own your ip's.

Though I agree with you 100% using a company like aweber who has whitelist agreements with the major ISPs, is a lot easier to insure your emails get through without any delay. But it's not cheap and depending on the size of your list it can be extremely expensive.

@invincible- No there are no requirements that they double opt-in from a legal standpoint.. You are however, required to have a means to opt out, mailing address and abide by the can-spam regulations however.
