I got sent dodgie printed letter from Monavie's solicitors telling me I have been cybersquatting on the Monavie name, keywords and phrases. They were quoting US Law and digital millenium copyright act...

Honestly do these wankers have any idea??? Firstly there was a major hole in their theory given that I am based outside of any American state... Secondly and this one is the cream on the cake.... They think they have jurisdiction over an Australian who has never been to their country...

I say fucking good luck... whats your thoughts...

Monavie :action-smiley-052:

yea but .com.au domains which is the one in questions are out of their reach... and ICANN can't do shit esp if you are overseas.... so ICANN tell Monavie to suck my balls...

but what can they dispute with the domain name IT IS AUSTRALIAN... They would have to go through AUDA not ICANN. The second thing is that AUDA would tell them to get fucked as there is nothing to do with Monavie on the website...

Just for a laugh I should attempt to get trademarks on euterpe oleracea. See how that goes down...Their core ingredient gets trademarked... then send them a cease order...

Troll them like you're an absolute computer idiot and speak in broken English, ask them for directions on how to transfer the domain, then ask if they can explain further because you tried to download the domain to the disc and the disc came up blank.

ok so everyone is worried about the domain name... big whoop.. the domain name is magicberry.com.au... so not one part of it contains a trademarkable name or component...

So that is totally out the window... they have no leg to stand on no matter what...

they are just fishing....

Product range states: "Açai berry juice: MonaVie Original Blend, MonaVie Original Gel Packs, MonaVie Kosher Blend, MonaVie Active Blend, MonaVie Active Gel Packs, MonaVie Pulse Blend, MonaVie Pulse Gel Packs, MonaVie (M)mūn Blend, EMV".

Don't see anything there and they're not using the keywords and are certainly not ranking for them so I don't understand what their problem is? Tossers.

That is what I am getting at... they have nothing... I think they are tossers...

Not that I am at all suggesting this is the case - but it is common practise when a company wants something without having to either pay for it or go through the normal channels - they'll have a scary letter sent from their Lawyers.

Lawyer speak letters shit people up - but often they're just garbage.

If you don't have trade mark terms in your domain then there is fuck all the twats can do.

Looks like a product based around snake oil and bullshit to me too - which then doesn't surprise me they're pulling this shit.

string them out, bro. they'll soon get tired of paying the lawyer $200 a pop to send you 'dont be nasty' letters.

Well least I may have an idea where their logo came from.
