I can't answer all your questions but I have answers to few..

Dup "Penalty" applies on content in the same site.. It is stated as well on the google Forums.

Duplicate penalty across the Internet is a different story. For example you have submitted the same content to 1000 different sites. Then around 700 got indexed. All will count as backlinks but Google will only choose 1 of those 700 indexed links to rank in the SERP's, better than the other 699 indexed links. I really don't know what's the case on your end cause you only have 2 types of the same content. But I hope you get the Picture. Spinning will give more value cause instead of having 1 of 700 rankings you will have more.

Atleast that's what I know about dup penalty. Might as well try to research more. It's a complete SEO myth that Different persons have different beliefs but not one gay ass webmaster has come with "SOLID" proofs.

Also another thing.. I'll try to answer your first question if I will know, what happened to the site? Is it deindexed? Slapped or what?

Yea the penalty will definitely pass through like this. If you can get hold of an aged domain in the same niche that has some authority you maybe able to reap the link juice without passing the penalty.
