(CNN) -- A state judge in New York on Monday invalidated the city's upcoming ban on sugary drinks in containers larger than 16 ounces in certain venues, a major setback for Mayor Michael Bloomberg, who has backed several laws aimed at New Yorkers' health.

The limit on the large drinks is "arbitrary and capricious," a New York State Supreme Court judge ruled Monday.

The measure was to take effect Tuesday, and Bloomberg's office said in a Twitter message that the city will appeal.

On the first hand, I'm happy to see government leaving the free-market alone.

On the second hand, I'm sad to know that health care costs will continue to balloon due to fat ass American drinking 92 oz. sodas while watching TV.

On the third, purely theoretical hand, I'm pissed that the government is making me pay for these fat ass American's medical bills when they shouldn't have been drinking this shit in the first place. Fuckin' socialized health care wins again.

My verdict: Battle won, war lost.

Must be nice to be the government. Have so much money, you can afford to sit around, and debate about how much pop other people should be allowed to drink.
 
They ban anything larger than 16oz containers.*

So really they're banning about 7oz+ of "sugary drinks", making people spend more, and the venues earn more because they order more than 1 drink.

Back in the day, insurance companies could kick you out for smoking or being overweight. They even *gasp* would send you a letter stating if you didn't lose weight by a certain period they'd cut you off. Thanks to our glorious leaders they have decided that regardless of the poor choices you make in life, you should get fair treatment. So a obese, pregnant, chain smoking heroin user has access to quality medical care, even if they can't afford it.
 
The gov't can't even ban cigarettes so idk why he thought he would be able to get away with this. Must have just been a publicity stunt?

edit: oh I guess it was because they were successful in banning trans fat, forgot about that.
 
This could possibly set a precedent where New Yorkers could fight the new gun laws. You could easily change large drinks to gun magazines
