Client didnt pay for work on website. What should I do.

Serious solution.

Start doing what they're doing for yourself, make more bank, take it as a lesson learned about verbal contracts and get out of the design and servitude business forever.
 


how do you know the site made $78k in 4 months?

Even after they locked me out of everything I still have access to the g00gle analytics that I set up for the eCommerce. So all money is tracked :)

I have decided to duplicate the site completely just changing the name and obviously the brand logo.

Questions I have:

1. Do I need to create the new site in someone elses name? Or am I safe to be the registrar and on the merchant account? I dont want them to claim copyright!

2. Where is a good place to get packaging. Like little baggies with company logo on them. Or plastic containers with brand stickers I can use?

3. Know of any merchants out there that still allow this stuff? Preferably in the states :)
 
Screwing with their website will just get you in trouble. Civil lawsuit or maybe even the boys in blue knocking at your door.

Knowledge is not copyrightable or patentable or whatever. So what I'm trying to say is you should:
1. Clone website.
2. Rewrite copy or generate new copy.
3. Duplicate his business relationships (ie sign up for some affiliate programs)
4. Register similar url (if he has .com, get .org or .net)
5. Grab the data baby and run.

I'm actually in a somewhat similar situation right now. A website owner owes xxxxx dollars (yes that's five x's) as revenue share but not paying.

No big deals. I'm on good terms with him still. I'm still administrating his site for free which pulls in good $xxxxx per month.

Because in a remarkable coincidence, in a certain number of months his site will be cloned by somebody who just happens to be somebody I went to university with.

It's a small world.

1- I'd switch the site up somewhat, your site was registered after theirs.
2- There are tons of places, a quick google search will show there are a ton of options. But in my personal experience, the best thing is to buy cheap jewelry zip lock bags and print paper labels. Much, much cheaper packaging (I'm talking a small fraction of the cost), which can then allow you to sell the product cheaper or keep higher profit margins. In the end, people just want to get high.
3- I know someone who might be able to help, but I have to ask first, not sure if they would be interested. In any case, many local banks don't quite know what it is ;)
 
Was he dick about it and purposely not pay you? If so then I would reclaim the site and take back what you created. If not then I think that is stealing.

Secondly, when have verbal contracts ever been useful to the person taking it in the ass? That part is definitely your fault.
 
Log into their hosting and put the code on their website that allows you to turn their site blank remotely, then follow up with a phone call to them asking for the money.

Can't remember the name of the website for the code, but it got posted on here before.
 
Not only was I suppose to have 20% of the company but I was suppose to be paid for the initial creation of the website.

Problem is it is all verbal contracts!!

I was also given a copy of CLAD as per our agreement. They went in and changed the passwords on that too!

So it is a contract that was made verbally? Did you verbally sign it?

Sorry man, but that's a huge no no.

I would honestly take all their data and replicate. They are pure scammers if they don't respond to your emails/calls. Treat them like shit.
 
You said you have access to godaddy (domain + hosting) so repo the site files off the server and install and "domain.com" blank html page. Some other strategies including killing the brand with negative reviews, rip off reports, complaint board postings. Another strategy is to login to the hosting and add hot link images/pages (headers for example) that you still can control offsite even if they block you out of the hosting. Depends on how bad you want to get.

Good luck with that but yea don't let them just walk on you. Take the site down and let them call you or take you to small claims.

Next time contract always and you don't give access until all is paid. If you are a partner you always keep your hand on something (the domain, the hosting, etc) something as an insurance policy.
 
Well it is now 4am my time and I have taken the great advice of my WF friends.

I have completely duplicated the website and changed all of the content and pictures to suite the new site!! Tomorrow I finalize everything after getting shop site eCommerce all set up :)

Revenge is a dish best served cold! But who wants to eat a cold meal!! I appreciate all the advice I got and even the criticism. At the end of the day you want too and hope too trust people. But as a beginner web designer I have been used and abused! It honestly put a sour taste in my mouth for wanting to build sites for anyone anymore!!

But I have learned Get a contract and get Payment UP FRONT!

Yes DChuk you are right!! The problem was I met him in a group of good friends so I let personal relations get involved with business!!!

The worst part was when we first started and got booted from G00gle checkout for selling a banned product. They couldnt find a merchant to sell the product. They started running all the credit cards through their tire websites merchant! They brand and sell their own label no affiliates.

Because they are on the registrar anything I really do to the domain or hosting can just be recovered so all I am is being a pest on the wall.

I do like the idea of cloning the website though :) I would have the same merchant issue though I'm sure. I do know where to find the product though :)

Friends. Business. DO NOT CONFUSE THE TWO.

as mentioned above you still own the copyright of your creation. Send them a nice invoice for the use of it, when (if) they dont pay hit them up with with some nice legal letters and claims court.

Keep all the proof of your work handy, drafts, sketches, mockups, wireframes etc. That is your basis to say its your work. (copyright notice in code helps!). They dont have the skills, no outsourcing backlog to say they did it themselves.

So go for payment / royalties for use first, then try and get them on an negotiation table and get your due + bonus for on going use and future licensing of work. Doesnt work a nice small claims. Though negotiations has the best "bang for buck".

Find a good IP lawyer that also handles arbitration etc;)

Now that you've duped the site, go in to theirs and install css killswitch. Turn their site off remotely and get yours indexed ASAP. By the time they figure out how to turn their site back on, you should be the authority site in google's eyes.

Check with AKLaw regarding legalities of said advise first though.

And get a fucking contract next time!
 
1. Create your new site.
2. Find out where they live.
3. Install PHP script to redirect all traffic that is not from their city to your site.
4. They still think the site is up, everybody else gets redirected to your site.
5. Profit!

That's the best. Smart move. Duplicate, then outrank them in Goog. Leave them alone, get on with your life.
