why dont you come up with a product/service call it "pubcrawler.com" and TM that... once that happens they have no chance... other option is get a virtual PO Box and make sure it is out of offending state register domain to same owner but in that other state and no jurisdiction...

not overly informed about US Law but it sounds easy enough to get around.
 


Yeah, if they haven't hit you with an actual C+D, tell them fuck off. Then, even with a C+D, tell them fuck off. As someone showed, they don't even own the trademark...

In a similar case, I have a buddy getting sued right now for using the word zebra with zebra stripes on his website... from a marketing company that uses zebras in their branding. Fucking ridiculous that this shit happens. Lawyers get paid either way, so they are willing to file these frivolous suits and "see what happens".

Because AFAIK you can't trademark a dictionary word in the UK. You can trademark terms that INCLUDE dictionary words (e.g. 'Orange Flibbertygibbits'). You can also trademark images that portray dictionary words in a particular style, but the mark is then on the image, not the word.

I would assume the mobile phone company "Orange" holds that trademark in the UK if anybody does.

Now back to the OP's story. It's fucking hilarious that we're talking literally about an organized pub crawl. Did you seek legal advice since you last posted?
 
local news has picked up the story, its been on fox and abc local news here as well as a bunch of local websites.

all of the news stories sure are making them look bad for trying to shut down an event for charity.

some lawyers called my client today and are going to represent him for free.

Their Exec. Level management might be a bunch of douchebags, but the beer is kick-ass. I drink Abita all the time in preference over all the other trendy micro-brews out there, including Flat Tire.

Their pub crawls are kick ass as well. If ever in New Orleans be sure and make one if you can.

I wouldn't worry about it too much. IANAL. But the only way they can get you imho is if you purposely try to infringe on their copyright/trademark.

I have a script that buys a lot of domains according to keyword search ratio. I get these kinds of emails/letters all the time. I basically just write back "no, sorry, I have never heard of you and I have no intention of infringing on your trademarks, good day". and I never hear back... not yet at least.

BTW, WTF is that white shit coming out of the last chick's mouth in the GIF? It doesn't look like there was anything there to begin with... gross.
