If I call a product a scam, but I really have no clue weather it is or not; could I get into trouble for this?

From Wikipedia - Penn & Teller: Bullshit!

Since their act is not normally associated with a frequent use of profanity, Jillette explains their choice of using the term "bullshit" in the opening episode: if they referred to people as frauds or liars, they could be sued for slander, even in the face of overwhelming evidence of chicanery, but as "vulgar abuse" is not legally considered slanderous, referring to them as assholes or motherfuckers ostensibly expresses an opinion rather than a statement of fact and is legally safer for them.

is this the basis of a how to make money off ripoff reports post that someone made earlier this month or so?

Yes. You could get sued regardless of what you knew and when you knew it. Details please.

Lesson : don't call it a scam. Call it a bullshit offer.
Bingo! No one can touch you for an opinion. =) And just remember, real lawyers never trust anything else than certified snail-mail.

I keep getting love letters from really horny 'attorneys' (read -- C&D letters) via eMail. I don't even bother responding to them and just press the delete button. Well, I am still alive. =)

If they have big enough pockets they can get you. Slander or defamtion of character. This is civil and would be for punitive damages as a result of your public remarks if they prove are unfounded. You lose.

Yes we are entitled to free speech but everyone is entitled to sue also

You have to consult with a lawyer. I have been sued for this when I used it in a real estate marketing piece about a dumb fuck broker and his disount services. But it never went to court. It shut me up though. Jail and losing money are the only things that will shut me up.

What exactly did you do/say?

If you don't know whether something is a scam or not, then why would you want to call it a scam anyway. The end result is that you could damage the business you called a scam and if they are not a scam then you could damage them.

If you are creating a product that is based on real and solid factual evidence, you should be okay. Just avoid certain language, and don't make strong accusations without your supporting evidence/works.

I mean, if you were to create something on say Ameriquest Mortgage Company and their shady practices (which was well publicized and a court settlement did occur in 2005/2006), then you can do that.

Now if you are on some personal vendetta and make to just destroy their name, image, etc...then I say tread lightly. But, get your facts together, and if you got something solid, get some legal assistance and do it.

Freedom of Speech is a privilege.
