Actually, in the interest of public safety, having a weapon clearly visible is probably the greatest possible deterrent to would-be criminals.

Why do you think police officers display their weapons and ammunition so prominently?

To discourage people from acting foolish around them.

That could certainly be one reason for an officer to have his firearm holstered that way, or it could be that the nature of police places him in situations that require a quicker draw.

I agree that having a weapon visible is an excellent deterrent to criminals. An even better deterrent would be hiring military contractors to patrol neighborhoods with AR-15s.

Judge Alex Kozinski dissented. He noted the following:

This guy has amazing balls to pull this off. BUT if this were anywhere else than a main street, in broad daylight, in a place like Portland, Oregon I wonder if it would have gone down the same way. I thought the cops (and I'm no fan at all) performed pretty well and frankly, if I saw a guy walking down the street carrying a gun I'd be concerned too. Should it be legal? Absolutely! but I'd just cooperate and give my ID to allay any concerns about what I'm doing. Just my two cents.

It is Portland, Maine. The liberal hippies banned open carry within the city limits of Portland, Oregon.

Not according to the laws they suppose to be upholding, laws which define wearing a gun the same as wearing a Metallica t-shirt.

It sounds like you might be under the impression that he was literally carrying it in his hand, which is not the case. Obviously the majority of people don't have a gun on them, but it's also not as super rare as many seem to think. Some people carry just in relation to their job, such as with certain security guards and Brinks truck drivers.
 
I agree with Raptor Jesus. He thinks that only the very intelligent and highest caliber human beings, like our brave men and women with police badges, should be allowed to open carry. How can you argue with that? We all know that only the best and brightest work in law enforcement, normal people just are able to handle owning firearms and carrying them in public. Stop being idiots about this.

Should I throw a sarcasm tag? Or will my previous forum posts that included the utmost hate and disrespect for anyone in law enforcement suffice?

Reminds me of a conversation I had with a family member:

Him: I own my house.

Me: It's yours. Nobody can take it away from you.

Him: Yep. Mine.

Me: What happens if you don't pay your property taxes?

Him: What do you mean?

Me: Nothing. Never mind.


Of course this depends on what state you live in... Some states they cant take your house no matter what you do... Income tax, property tax, law suit... whatever... That shit is yours!
 
Only read half of the comments in the thread, not sure if anyone already addressed the obvious.

Do you think the open carry gun law in Oregon is going to be a simple one liner, "Anyone within the boundary of the State of Oregon can openly carry a gun anytime, anywhere. Have great day!" ?

Pretty sure it will say something along those lines with an additional, "providing that...." and a list of 1000+ terms.

Like maybe:

- must be over the age of 18
- must not be within school zones
- must not be a convicted felon
- must not have mental illness
- must not be intoxicated or under the influence of mind altering drugs
etc.........

The cop could have gotten his ID legally in many ways. "We need to see your ID to verify you are over the age of 18 (as per section blah blah)" (and to run his name to make sure he is not a convicted felon etc. to make sure he meets "all requirements" - all for public safety of course and by law - not to be a bully and trying to show authority).

I did a quick search and the actual direct laws didn't show up without digging around... there is this: Chapter 1040 Oregon Laws 1999

the laws will look something like that.

Anyway, this kid wants to make a youtube video showing he doesn't have to give up his ID and can carry a gun around openly.

Wasn't there, but to draw the attention of someone in the public to call the police to investigate it, did he maybe do something peculiar to draw that attention to himself. His goal was to have that confrontation, his script memorized and ready to go for the big moment.

Anyway, point is there will be more to the law, all for public safety.
 
As I'm in the UK, and this whole scenario seems totally fucked up from both sides (the fact you can open carry, and the fact the cop doesn't have the right to demand a permit), could someone please explain to me, why Americans think that a) it's OK to carry a gun (or any other deadly weapon) and b) that cops shouldn't be able to demand a permit?

On your A/B questions here is a clear answer.

a) The minute you give up your right to own/carry a weapon. Is the minute that you are pwned by the people that DO have weapons. It is called self defense and it is a RIGHT to defend yourself. Nuff said.

b) Cops should be able to see a permit period. I didn't watch the video but the cop should have every right to check that permit on that dude.

In the other Portland on the WEST coast. This dude would have been fucking shot dead and they would go thru his pockets and say "oh shit, he had a permit".
 
even before the cop asks me for my CCW I would happily inform him I am carrying and offer my ID, weapon, and permit up so he can make a proper assessment as to the threat level to not only his life but also the community he is serving. This way we can both feel safe and assure that we will both go home to our families after we are done.

Kudos. That's how it is done son. Civilized is this.
However, you still might get shot in Portland, OR.
 
Once again... NO PERMIT IS REQUIRED to open carry in the state where this video was recorded and many others.

The permit must just be for concealed.. I love the idea of just having a weapon. You know the most secure country in the world.
