Domain stolen name.com wont help

Whole thing seems whack.. not sure how that could have happened but it sound's like name.com dropped the ball somewhere or needs to heighten security.

Get a trademark on the domain name, then you own it and can sue anyone else for using it.

Even if i register a tradename where do i register it? USA or where? The domain is registered in india. What else needs to be done? Do i just register the tradename and contact the registrar or do i need to file with i icann for another $1300 or do i need to hire a lawer and pay more money.
 
Looked into a trademark and thats also a pain in the ass just because you own the trademark it does not give you any extra rights to a domain name is what i am told and if i want some to stop using my trademark as a domain i would have to goto court.
 
You would not have to go to court. The large majority of lawsuits are settled out of court. A cease and desist letter would probably be alll that is needed. In the state where i live a trademark is $45. You should do it now while ur site is still up. Then if they transfer ur domain or anything u have a lawyer right them a letter.

It sounds like some info is missing from this story- to transfer a domain the registrar must be notified and the admin email address of the domain name owner needs to receive a verification email with that requires approval for the domain name to transfer. So keep hassling name.com for more info, ask to speak to a supervisor and tell them you want to avoid having to get your very expensive lawyer involved (even if you don't have a lawyer.)

If the email address on file was compromised, that can explain why the OP never
received notices for this. Seizing control of the domain's email address on record
is a frequent method used in actual domain hijacking cases.

Also, a trademark isn't necessarily meant to take back stolen domain names. But
I understand that's an option to look into since anything's better than nothing.

Truth is, persistence is really your only ally when trying to solve these things.
 
I had a friend who recently had a similar situation. I can send you a referral to the lawyer if you PM me. He's a great guy and his private rates are very reasonable for handling UDRPs.
 
And why would someone take your domain, but leave the name servers still pointing to your site so you would not know. More importantly, how could the domain be transfer without you knowing if the email address in the domain contacts was correct? And you have other domains, but that is the only one taken...?

All the weird questions aside, I would approach this as if you transferred the domain and forgot about it. Contact the new registrar and tell them you don't have any of the account information for the domain. They will make you jump through some hoops, but you may get access to the account at the registrar. After all, it's pointing to your site and you do have the original transfer emails that show past ownership. If some other person owns the account, you may not be able to get into it, but you may learn who that person is and perhaps what other domains they have.

If you domain was stolen (possible, but unlikely IMO) then the crook many have many, many domains and not be bothering to change name servers and just be trying to sell them. Either your domain is no so great, or they have so many domains they may have forgotten about yours.

That is how I would approach the problem. If someone does have your domain, Hound the current registrar to get the current owner to produce proof of their ownership. It sounds like you have that and they won't. Good Luck!!!!

P.S. One more thing: See if you can get some information from Name about the transfer,like the IP address, email address, or anything else that may help. I don't think a lawyer can help you if you don't have evidence of what happened and who was involved. And if you have that the registrar should comply. And you could try contacting the CEO of Name.com. I have in the past and found him to be a really good guy. Just don't expect too much and blame them. There are safeguards in place to prevent this kind of problem even if they fail.
 
Some dick thought I ripped him off (I paid him what he asked, but then was confused and I guess wanted more). In summation, he researched the mess and threatened me with an ICANN thing. I think it was like 800$. It's an arbitration type deal. I think thats your own hope. So the question is, is the domain worth 800? If so, thats probably your only shot imo
 
Thanks for the info guys, ICANN wont help as it's been too long. I do think that it was stolen and their s not much I can do about it now as everyone is just telling me to move on.
