eBay Scammer... advice?

Before I start I know this is partially my fault but don't flame too hard.

Ok I think I've been caught up in an eBay scam. A few days ago I listed my iPhone 3G for sale. I shipped it per Paypal rules to a confirmed address with signature confirmation and all of that. The buyer emailed me today with this:

um like were is the fone at u sent me an empty box with no fone. if you didnt want to sell yo fone you shouldnt not have put an ad up. rite now im not liking how u do bussiness. were is the fone man or i want my money back.
Now because of Paypals stupid rules they have been holding the money until he leaves positive feedback, well he left negative feedback instead. He hasn't filed any disputes yet he's just been emailing me with stuff like this:

it couldnt have fell out because it was sealed up good.i sign and everything when the man got here and i notice that the box was empty so be honest and to tell y u aint send the fone when i just paid my 250 dollars on sumthing thats not even in the damn box.
Problem is "the man" didn't "get there" the tracking number shows they left a notice on the door, which means in order to get it today he had to go into the post office and pick it up (with ID). I have a signature confirmation from USPS proving he signed for it, but I'm not sure how to handle this since he's not disputing the fact that he got it, he's just saying there was nothing in the box I shipped to him, which I know is a lie.

So anyone ever experience this, whats the best way to approach this.
 


doesn't USPS provide package weight? that right there would win the case for you when going through the dispute process.
 
Not on the tracking information, no. They may have a record of it somewhere however.
You would have a record of the weight and zip code on the white receipt the post office gave you. Or if you used online postage there is an online record of the weight.

I just sold a couple of things there because there was no other outlet for my stuff. No problems from these two, thank god. I know what it's like and feel your pain.

Your auction "winner" sounds like an illiterate retard making a marginal living chiseling ebay sellers.
 
How did you mail it? First class? A box with a phone it would obviously weigh more than one without. But that's a tough case to argue. You could have potentially put something else of equal weight (from the buyer's perspective).

Then again, he said the box was empty. So, he can't change his story on that. The shipping charge should prove your case.
 
if he is not filing a dispute you will get your money after 21 days, even if he leave you negative feed back
 
I don't know much about Paypal/eBay policies, but I thought that when you go through the dispute process if you can prove that you shipped the person something, then you automatically win the dispute. Because of that I remember scammers selling stuff on eBay and then shipping an empty box, or a box of phone books and then they would win the Paypal dispute because they could prove they shipped something.
 
I'm looking for the receipt, I hope I can find it. I cleaned out my car yesterday *gulp* I'm not sure if he is going to file a dispute, I don't know if he's smart enough to be honest. I figure he'll just charge back with his bank and royally screw me.

EDIT: It was shipped Priority Mail 2-3 day, with signature confirmation.
 
You found the receipt?

Insurance won't help at all. A claim has to be filed by the recipient of the package, and both parties have to cooperate. The shipper has to swear that the item was shipped intact, and the receiver has to swear that it came broken.
 
Hard to get 100 feedbacks when shit like this happens. Insurance doesn't cover magic tricks like a phone magically disappearing from a taped and sealed shut box. The buyer has now filed a dispute with ebay. I have 4 options:

Offer other solution (I get a message box that sends back to the buyer)

Ask the buyer to ship the item back (he'll send back an empty box)

Refund the Buyer (Not gonna happen)

Escalate to eBay Customer Support (best solution)
 
you could always buy $0.01 items to get 100 feedbacks, at least, thats how i did it.
I don't know why you guys are obsessing about feedbacks. They can pull this shit at any time, whatever your feedback. I have almost 900 feedbacks, 100%, and it doesn't protect me at all from buyers like this. The customers can pull whatever stunt they like and sellers have little recourse.
 
Yeah, they can pull this shit anytime, but if you have a long track record, you can absorb the negative feedback better and not have it affect your other listings.

What kind of feedback did this buyer have anyway?
