Thank you for the reference to my post on my site, there have been many other spam lawsuits that Facebook launched that do not get press attention, some guys who got sued for the exact same thing settled with Facebook in September for $20 million. The settlement got no press at all. Anyone can find these suits by searching justia's website.

It should be interesting to see what comes about with this latest series of suits.

Networks aren't immune to lawsuits from pubs. Otherwise they could get "pubs" and do a lot of illegal stuff and always get away with it. But it's still a gray area whether Facebook has a case here.
 
"In three separate complaints, we allege that Steven Richter, Jason Swan, and Max Bounty, Inc. used Facebook to offer enticing, but non-existent products and services. According to our complaints, the defendants, among other things, represented that in order to qualify for certain fake or deceptive offers, people had to spam their friends, sign up for automatic mobile phone subscription services, or provide other information."

Interesting indeed! In order to hold a network liable, imho, they would have to prove that the network was in some way conspiring or negligent.

Steven Richter of Kings Park, NY. The Steve you're thinking of is from CO, and would be the last guy they'd want to sue.

Otherwise network A would create an account at network B, spam the shit out of Facebook, and then proceed down the alphabet until they're the last network standing.

In fact, with all the cloaking and redirects going on, it's completely feasible that MaxBounty had no idea where this traffic was coming from.

Umm yea, so allow companies to game and fraud people with a layer of plausible deniablilty based on a hypothetical. Did your parents have any children that actually survived?

It is called taking responsibility for the businesses you have representing you.

It has come to our attention that Facebook has named MaxBounty in a lawsuit. The complaint alleges that certain MaxBounty affiliates have caused Facebook users to "spam" their friends, use Facebook trademarks, and post deceptive offers.

MaxBounty merely acts as a traffic broker and statistical tracking system between affiliates and advertisers. MaxBounty has not "spammed" anyone on Facebook.

Facebook's allegations in the complaint are inaccurate. Regardless, we have every intention of cooperating with Facebook, to the extent possible, to ensure that all applicable laws and Facebook rules and are complied with. MaxBounty has a reputation of not allowing spam or deceptive advertising practices by its affiliates on social websites. In the past, we have removed affiliates from our network who had engaged in such unacceptable campaigns.

We expect this matter will be resolved promptly, amicably, and without any disruption to MaxBounty's business for advertisers or affiliates.
