The 6th district court (which includes michigan and a few other states) have ruled 2257 as unconstitutional. So unless the appeal goes thru or such its not illegal to not have the records. But as a cover-your-ass policy ... best to do so.

As a photographer on the side, I'm not a fan of the 2257 record keeping policy because they've already tried to make revision b include requirement for non-nude/non-porno situations, even when the scene is not pornographic but could include a seductive pose, even if fully clothed.

Far as the model release part... only applies if you can see their face as a recognizable likeness. You could make commercial use of the rest of the body, only in the event you didn't invade their reasonable expectation privacy in the act.

I'm fully aware of the 6th district ruling, which only covers the 6th district, not the whole country... also, one rule revision by the DOJ and that ruling will mean dick...

my point is, you're not going to get away with it forever... at some point stealing content and/or covertly taping people will catch up with you... not to mention that in some states it's illegal to record somebody without their permission... it's just not a smart thing to do...

I'm not a photographer... but I've spent 5 figures on adult content buys in the last year alone and I can tell you it's much easier to just buy content and not have to worry about it, especially if you're trying to run a legit business...

Hire actors to simulate random encounters in bars etc. (ie, regular porn with shitty cell phone cameras.) You could hire couples who want to get their amateur exhibitionism cherry popped for cheap.

exactly... I don't really want to get into a long drawn out discussion about content, but if you're going to make or buy content, imho it's better to do something that hasn't been done to death...

I've seen a lot of people come up with 'ideas' about making porn or porn sites, but most of those ideas aren't any good because they won't sell or at least won't sell very well...
