I sold a site but the owner didn't take it.. WTF.

Ditto what's been said on here, sold a site for just short of X,XXX and the guy never changed any content. It had an awesome design aswell.
 


Maybe he's really busy or something happened to him, just sit it out for a month and if he doesn't reply or replies after the month say that you don't know what he's talking about....

3: If none of the above work, just forget about it, or repeat step 1 & 2 at your convenience.

You're not obligated towards him to constantly try to get in touch with him, he is obligated to himself to complete the transaction, and as long as it's keeping you making money it's not a problem for you would it? ;)

As far as this goes, a legitimate contract has been formed.
Payment has been received, it is now his duty to deliver the goods.

If he wants to stand back from the contract, he should better have evidence that he tried to deliver.

He might still be obligated to deliver whenever the buyer reappears.

That includes any money made from the site if there hasn't been an adequate effort to deliver.
 
I know this will sound stupid but the site was making about $300/month and I sold it for like 3-4 months revenue just to buy new clothes, (Yes in highschool)... lol but i guess god has given me a second chance with this site hahaha.



Seriously dude, worst decision you could make. The total value of those clothes in 12 months is dick. The total value of that domain in 12 months is at least $7200. (previous 12 months revenue X 2)


You took $1000 profits instead of $6200 profits, not a smart move.
 
yeah but it is now sold. so yeah, try to contact him. keep track of all emails etc. in case he ever does claim it and tries to say you never tried to contact him, etc. If you REALLY want to locate him you can do a $29 people search. But all that's really required is you trying to contact him via the contact methods he provided already. He is not entitled to the earnings you get while he's being a slacker. You just keep making money off the site, and then if and when he contacts you, you turn it over to him. I would not trash the site or anything though. Ever. Partly because you're making $ off it, and partly because he may one day appear and say he wants it and then you wont have it. And THAT could be a problem.
 
I feel like an idiot admitting to this... but I have spent THOUSANDS of dollars (under $10k though) over the last 3-4 years buying sites and domains, paying for them, and just forgetting about them or being too lazy to transfer them and host them myself. I remember buying some type of Family Guy aff download site a few months ago on SitePoint, transferring the domain, but I'm pretty sure it still points to the guy's page, and he's still making a few hundred bucks a month off of it.

In fact, I have a list of domains that have still yet to be transferred to me because they are at different resellers or registrars and I've been too busy with other shit to even care.

NamePros hates me now because I bid on like 15 domains, paid for all of the big ones, transferred one or two of them, and forgot about the rest. The owner had to get in touch with me because I never got an email telling me I won the auctions, and although I still want to make good on it, that was weeks ago, and I'm sure they all think I'm some small time delinquient domain buyer, heh. I feel bad, and I totally would pay for it all, but to be honest, my time is so fucking limited, I can't take care of simple tasks like that.

So overall, I totally understand how these buyers who forget about shit they buy feel, or why they forget. It's completely retarded on our end, and I know most of you don't get it, but when you have say 30 things to do in a certain amount of time, you tend to take care of the things that are more important to you and your business, instead of the "well it seemed like a good idea at the time" type of deals.

Try to get in contact with him. If you can't refund him half of it as a show of good faith. If you have his paypal addy and he doesn't accept the half refund, then just keep it and consider yourself lucky that you got the threads you wanted and got to keep your money tree too.

It depends on what state you live in, and what state he lives in.

Most states in the US have a law that if he never takes posession of the purchased merchandise he is entitled to a full refund upon request.

You really want to check in your state especially, because some states issue penalties to the seller for not issuing refund automatically after a given timeframe.

Also, have you contacted the administrators of SitePoint? Because the sale of the website was conducted on their forums, their policies would more than likely be the governing laws of sale.

I'm glad someone else had the sack to admit this before I did. Guilty of this myself, especially when I went through a growth phase in late 04-early 05.
