The prosecutors can normally find a way to get shit like that in front of the jury anyway. You'd be surprised at some of the dirty shit I've seen them do. And since in the US prosecutors have what's called "absolute immunity" they can even break the law in the process of presenting a case and can not be charged for it. Normally your only recourse is getting a new trial on appeal after sitting in prison for a couple of years and the odds of that being successful are remote.

So yeah evidence is nice and all, but in the absence of that they just find a plausible suspect and make it work. That law just codifies what they already get away with. Go Murka!!!1!1!!
