Currently, companies found to have run deceptive ads are
subject to fines of up to $16,600 per viewer.
Under the proposed provision in the House version of the bill,
the FTC would also be able to fine agencies that did the work a
nd, ostensibly, media outlets that broadcast or display the ad.

Anonymous proxies should be an interesting asset which to invest money in.

From HR 4173 a la "aiding and abetting" which is the main concern here for pubs:

"...any person that knowingly or recklessly provides substantial assistance to another person in violation of a provision of this Act, or of any rule or regulation issued under this Act, shall be deemed to be in violation of such provision to the same extent as the person to whom such assistance is provided...."

So if as a publisher you run an ad, you aren't KNOWINGLY running something deceptive (if it's proven deceptive later)

If the Advertiser told you "This offer is a bit shady, fraudulent, etc" and you ran it, that's a diff't story.

"reckless" is a word the courts will test. I don't see reckless being a pub who grabs an offer and runs it. Diligence can only go so far when you're presented with hundreds of ads to choose from on a daily basis.

The Republicans have filibustered the finance reform bill for now. But the Democrats have called for a procedural vote on Monday. So long as none of the 41 Republican senators vote for the bill, it will not pass. They have already sent a letter declaring they will not vote for it. With this being an election year they may waiver. In this case, I hope they don't. For a lot of reasons, if not just for the provision listed here, this bill needs to be stopped.

If you really do care about the potential negative effects this bill can have on your internet marketing and if you have a Republican Senator I'd urge you to call their office between now and Monday and tell them you support their decision to block this bill. If you have a Democrat Senator, I'd suggest you call their office and tell them you think this provision is a bunch of B.S. Instead of trying to think about a "work around" you should go to the source and try and prevent this from going into law.

This is what happens when Democrats are in control. Cradle to the grave services and government expansion. Who needs a brain if Uncle Sam can do your thinking for you? I hope the GOP can keep shit under control until they take back the house and some Senate seats in November.

This is a really important announcement from Altrec. The FTC will find anyone $16,000 if you are using the word ?BAMBOO? in a product description, in content, in a url. Can you please take down any links, products or content that refers to anything Bamboo. This is not a joke the FTC are sending out warning letters to everyone and they will fine anyone in the process.

I just got this email from Altrec about their affiliate program. I am pretty sure they are nuts, but WTF. LOL

Shit is outta our control. Just sling' for as long as you can and if shit hits the fan you lose your bankroll (maybe some jailtime? lol) and then get into the drug trade. Problem solved.

Besides, they have always had super strict, ridiculous laws that puts just about every websites on the internet in jeopardy. Once in a while they will make a statement, but they simply don't have the man power to enforce it. You're chance of getting in trouble with them is like 0.01%.

No need to get stressed about this. Smoke some weed, laugh at how dumb the new rules are, and get the fuck back to work!
