Here's the only Dean from North Carolina that matters.

You should be exiled from that fine state for blasphemy! Then you won't have a problem with the Amazon tax.

lol...all i got to say is launch campaigns like the brother won games and ya'll own a bball team...

and everyone should stop calling it an Amazon tax, they've covered everything, if a squirrel farts in your backyard while you're surfing the web you get fucking taxed for it. i'm telling you.

From NY where the first tax like this started. Seems 80%+ of of companies don't even care??? lol?

Mostly only big merchant affiliates programs care, Amazon, CJ and the like.

Or just change your address on the profile? :)

Exactly, why move? Can't you just open a P.O. Box in another state, get a registered agent, or use a friends or family address in another state. Is there a reason for not doing the above?

The looming CA bill is largely responsible for my decision in regards to not buying a house here even with the 8k credit. Why pay all the closing costs and the headaches on a new home when my income could be wiped out overnight.

I feel for you guys in NC.

It still surprises me that Amazon (and other merchants) are willing to cut out all affiliate volume from a certain state just in order not to have to charge sales tax in that state. Really, what are the odds that someone will abandon an Amazon transaction because they get charged sales tax? Probably extremely slim.

This really doesn't make sense, since Amazon.com does charge tax in NY, so obviously they've kept affiliates from NY (Amazon.com: Help > Payment, Pricing & Promotions > Sales Tax).

I just moved to NC, and my business partner is moving to VA, but my LLC is based in NJ (registered + business address) and will continue to be, so I guess I don't have to worry about getting cut from any programs (unless NJ does the same).

The bill applies to where you physically reside not where you incorporated.
It doesn't matter in my case. My LLC is registered in, and based out of NJ, though I no longer reside in NJ. All business dealings still go to my NJ address, and there is no way of advertisers knowing my location. Since one LLC partner is in NC, and one in VA, what should they do, charge sales tax on half of my transactions? No. They pay to my NJ LLC, that still has its physical presence (bank accounts, address, registered agent) in NJ. No affiliate money is paid to me directly in NC. It's not like I registered a Delaware corporation but my address is still in NC - My address is in NJ.

Frankly, the easiest way to get around this (if you're a high volume NC affiliate of a company cutting NC affiliates) is just to get a virtual office or forwarding address in another state. It's not your responsibility to the state to have the payment address in state - It's the advertiser's responsibility to figure out what affiliates reside where, and the only way they do this is through payment & mailing addresses.

Of course, the solution is very simple. After getting your business in another state, get the bank account, PO box, and you're all set. I know people that do this just for privacy issues (and yes, theyre paranoid to boot)

Right on Johu. The only catch is if you're an existing Amazon customer and you live in NC and you want to make a switch, you'd need to open up a whole new account under your new business name to make it work... not a big deal.

I for one am not surprised over this issue. I don't want to get political here but since Obama has been in office we have lost so many rights as American citizens it's a joke. Theyre doing thousands of under the radar sneaky things. Bah!

Not the smartest comment I've seen in a while - First of all, this is a STATE issue, not a national issue. What Obama has to do with this is beyond me. Second, the issue here in NC is a bi-partisan sponsored bill - 2 democrats and 1 republican. What the hell a republican is doing co-sponsoring the bill is beyond me, but when states are hurting for tax revenue, all options are on the table.

People complain about taxes being too high, then complain about having to wait 3 hours at the DMV to get a license because half of the DMV office was let go, and they don't have enough workers. Unlike many businesses, the government (state, national, local) seem to forget about stockpiling money from surpluses to help in worse economic times, and instead increase spending unnecessarily or give short term tax breaks.

No you're right, this is a state issue. My venting on Obama is based on other issues. But I lump the whole process together as a fucking joke.

You're absolutely right, Obama has nothing to do with this. I'm not going to even go into what he has done, not the right place for it. Start an Obama thread in Shooting the Shit, love to debate with you.

Yeah some of the companies that work with affiliates have worked out to just charge sales tax for the individual states. IDK I can't keep up with everything.

HAHA, you think MORE taxes would help government services?!?! You got to be kidding.. its called a monopoly and no competition. What incentive does the DMV have to be "Better" ??? NONE, there is nobody to compete with them, nor is there any incentive to their employees to do better?

NJ's DMV used to be awful. Then they hired a consulting firm, renamed it the MVC, and threw a little extra money at it - all the sudden, 2 hour waits are now 15 minute waits. The incentive to do better is to get people out the door - otherwise, if people can't leave, they've got to stay overtime to clear the queue of people (which ends up costing the state a LOT more).

The solution isn't always more taxes, though - NJ ended up increasing the license and registration charges, which covered the changes (and an extra $5 for a license that's renewed every 4 years isn't much if it'll cut and hour and a half out of my wait).
