I'd appreciate any tips on how to protect oneself against lawyers.
What I have done so far is:
1) Created an LLC
2) Privatized my domain registrations and changed registration name to said LLC
3) Change/Create accounts where I advertise to said LLC name
4) Separate bank account at different bank for said LLC.

Curious as to what liabilities may be out there for affiliate marketers.

Lawyers are ok when I want one but when I dont want one they can be hell..

Sounds like your set. Damn, your takin more precautionary methods than I am. This here is a paranoind motha truckka!!

Yeah I'm paranoid.. especially about one particular individual.. but I am so paranoid that I dare not mention the name on a public forum..

This is quiet useful thread. I have a similar frightening about LLC and tax.

For the domain and hosting, still don't get what you mean.

Thanks for the post redmonkey.. love the redmokey moniker btw

taxes are interesting.. but seem more straightforward..
for my situation, and I havent talked to a tax attorney, the llc is expedient right now.. it protects from liability pretty well, I gather, if you create good separation, and taxes are pass-thru.. pay taxes same as a sole proprietership.. taxes are done on schedule C.. this is what I understand.. simple.. for high rollers taxes get more complicated..

I don't do all of this, but if you're really paranoid:

  • Get a host that's not based in the US. Canada/UK even are ok, but the less friendly the country is with the US the better(UNLESS it's a country that is associated with terrorism/nukes/whatnot). Make sure the host knows what you're doing and is ok with it.
  • Offshore LLC to register domains as.
  • Privacy Protection+use the LLC as the registrant.
  • Get a prepaid cell phone to use for domains(behind the privacy). Make sure it's rechargable w/ cash so you don't lose the number. This number is often the only thing used to check legit reg info.
  • You can rent mailboxes in random countries for pretty cheap. Or apartment complexes can act like they have one extra apt # for mail delivery purposes for a little cash.
The real issue though is aff networks having your information. The LLC can provide protection there though, but use your local laws and whatnot to decide how to protect yourself to this end.

thanks xmcp123.. I have a connection in Brazil that may actually provide some use for me now.. need to call the guy..

not really good enough..

if you're a single member corp, any lawyer will argue the alter ego theory that the veil of protection should be pierced and the single owner should be personally liable for a business obligation because, in essence, the single member is really the true business party running and owning the business that has caused some damage or liability.

For a relative beginner though, inc. may be overkill.. how safe is one when diligence is given to creating clear separation?

First of all, do not bother with web hosts.. having a web host is like waiting to have your next $1000/day technique stolen. Many people have access to your content (whether you would like to believe that or not) - sys admins, host owners, depending on how large/small the company is they may actually go through your files. I upload everything on shared hosts with this knowledge in mind.

Get a dedicated! I can't stress how much a dedicated has helped with little things here and there. If you are worried about security, get an offshore dedicated. I honestly couldn't imagine being an affiliate marketer without a server (let alone PHP/mySQL/linux knowledge). Even if you don't have linux knowledge, places like Liquidweb are good as they have managed options which are actually managed.http://ok.com

Offshore hosting. Try to get reg done with prepaid phones. Make any payments with Amex gift cards that can be activated from a public phone.

Privacy Protection+use the LLC as the registrant.
This. For mailboxes try using ones at abandoned apartment buildings. Apparently mailmen still deliver to them. Dunno why. Just break the lock on the box and it's yours. Another method is to use the address of some pensioner who doesn't check his mail. A friend of mine who has much reason to remain anonymous pays the Chinese guy running a shop on the corner of the street to hold all his mail for him. He doesn't know who my friend is, he just takes his money and holds his mail for him. So I guess that's another option.

If you are fucking around doing fraudulent stuff no LLC can protect you.

also don't ever co mingle your funds. Don't spend corporate money on personal stuff unless it's a business expense. You will lose the corporate protection.

Also ask legal questions to lawyers and not to affiliate marketers ;)
