Attorney General Madigan Files Suit Against local affiliate marketer



Yeah I want to see how this case breaks down. Hope the affiliates get off by finding a loop hole. Pure politics. They're going after affiliates because they're too cowardly to go after the credit card companies and the guys in the infomercials selling blue stuff. "That's why they call it marketing"! Our job is too sell, the customers job is to read the fine print, if they have a problem with rebills cancel the credit card. In fact before they come after us they need to go after Bally's Total Fitness and their shady membership contracts. The government just wants a bigger piece of the action because of how much money is flowing through the industry. We need to get some lobbyists, haha!

Damn... these companies really need to learn how to let customers cancel.
Actively preventing cancellations, or charging after a cancellation was "confirmed" is really what will screw the advertiser over in the end. Legal arguments can be made regarding the fine print and the rebill agreement, but there's not much that can be said in terms of preventing cancellations.

Exactly. To think that you can drive that much volume in such an extremely obvious and shady way is just pure arrogance. Those guys were so intoxicated with all the money that they couldn't see the obvious.
 
Whoa I would have expected more than 175k, but good to see a resolution.

That only mentions a resolution for the lawsuit in Arizona brought by the Arizona AG. There are other cases brought by the AGs of other states, and then there is also the case being filed on behalf of Harpo Productions. This is probably only the tip of the iceberg.

My guess is the affiliates will get an offer for a $10k settlement + lawyer fees + permanent injunction from using the Oprah/Dr. Oz names for marketing again.
I once got sued for "$10mil + lawyer fees + a permanent injunction barring me from ... + a few other things"

The $10 mill figure was justified based on $82,000/day in damages for a rather long period of time.

The settlement ended up costing me less than a fancy night out (on a condition that the money paid doesn't constitute admission of wrongdoing on my end) + 2 solo mailings for the plaintiffs to my list.

So the initial number doesn't matter. It could be $1 or 10x GDP of USA. They can ask for gazillion-bazillion and still settle for some nominal fee.

But I got a feeling that somone's ass is definitely going to take it hard.
