This seems fair.

Admitted thieves are going free, while an elderly Wheat Ridge man is facing the possibility of spending the rest of his life behind bars, all, he says, for trying to defend his property and his life.

82-year-old Robert Wallace said in February that he looked out his window and saw two men hooking his flatbed trailer up to their pickup. He yelled at them to stop, but they sped away, stealing his trailer. He told police he fired two shots at the pickup.

Minutes later, police say 32-year-old Damacio Torres dropped 28-year-old Alvaro Cardona off at a hospital emergency room with a gunshot wound to the face.

Torres did not stay to talk with police, but they caught up with him later. According to court documents, he admitted he and Cardona stole the trailer.

Wallace did not want to talk on camera, but when we asked him if the two men threatened him he said, "They almost ran me over."

The Jefferson County DA's office said that neither Torres nor Cardona have been charged with anything at this point, even though Torres confessed to the crime. However, the homeowner, Wallace is facing twelve felony counts, including four counts of attempted first degree murder. If convicted, he could spend the rest of his life behind bars.

Sources say Torres and Cardona are believed to be in the country illegally and both have an arrest record. Cardona's record includes public fighting and numerous traffic offenses like driving without a license or insurance. Torres's record includes agricultural trespassing as well as a 2005 arrest for aggravated motor vehicle theft for which he was given a plea bargain to a lesser crime. Sources say Torres is also under investigation for being part of a major auto theft ring.

Wallace is out on bond and due back in court in September to enter his plea.

Neighbors say the thieves should be the ones facing charges and Wallace should be given an award for protecting the neighborhood.

So remember, you're not allowed to actually stop people from taking your things. You can yell at them, and tell on them, but the moment you equalize the playing field by shooting at that person who is actively stealing from you - you're in the wrong. After all, those guys probably needed that trailer more than he did.

It wasn't point blank, they were driving away and he took a shot at the whole truck. That's not excessive at all.

Other scenario:

He doesn't take a shot
goes to the police
they file a report
2 weeks later find his trailer stripped out/burnt out.

Man fights insurance company for payout.
Scumbags keep stealing things.

I'd much rather him take the shot ;)
 
If someone breaks into your house and you decide to shoot them, make sure they die. Otherwise, they'll sue you or get you in prison. They have more rights than you do, as is shown time and again in cases like these.

That's fucked up. I used to live in Wheatridge, nice place with lots of trees and good people.

The guy shouldn't have shot them, but how in the heck do they both walk away with no charges? Why would the Wheatridge coppers protect these guys from charges?
 
Shooting at someone over a physical object isn't ever right.

I wouldn't think twice shooting someone if they were attempting to break into my house, in my house, trying to break into my car, etc.

Unless they're armed I wouldn't shoot them. But you better fucking believe their legs would get shot out if they had any kind of object like a knife, baseball bat, etc.

Actually my alarm started going off one night at like 1:30am and I was up working in the office. The alarm company called... told me it was coming from the basement door ((that leads to the garage (there's no alarm in the garage)).

I went down with one of my old hunting knives and a baseball bat and if someone happened to be around the corner they would've been seriously injured or dead... not by intention but in the heat of the moment you never know.

Turned out the door wasn't fully closed and the dog rubbed up against it and opened it.
 
That's so freaking stupid! How could someone even think of convicting an 82 year old man for protecting his property from people who are not even legal?! This is an outrage!
 
Sad. How does the DA justify no charges being brought against the illegals? At least deport their asses after a 90-day stay in a federal *pound me in the ass* prison.

This was CO, but it would have been legal and the homeowner would not be charged in TX, especially if the theft occurred after dark. Maybe the homeowner will get light sentencing if convicted, but I think that's a big if.
Charge the fucking illegals, though...Geez!

Call me crazy, but I was thinking that the thieves stealing something that did not belong to them was excessive.

It's a damn shame that the thief didn't die, cause regardless of his status if the 82 year old guy defending his property gets prison time for this ass backward indictment it's effectively a death sentence for the geezer.

Totally agree, not to brag or anything, but Im a BAMF and when I go rob places I always bring a small child in the hopes that I end up robbing someone like johnysc.

No, seriously who the fuck brings a small child when they go robbing? Genuine question.
