Divorce Laws - Unreasonable?



Blu, I get your rant, but come on. We can bitch about the system all we want, and cast our votes for Ron Paul and all that. But at the end of the day, the system is what it is.

Those of us who are smart, rich, or powerful enough need to work AROUND or ABOVE it, not WITHIN it.

First, there is absolutely no reason why Kobe ever needed to get married. He could even have quality children raised without a wife if he so desired. If this one said "no marriage and I'm gone", he would have met an extremely high quality woman within weeks if not days anyway.

Second, he should have known better and gotten a prenup, as we've all said. Dude's been playing pro ball since what, he was 18 or 19? He got married in 2000. Plenty of time to have enough money and power to swing this. But clearly not the brains.

Kobe is uber-elite-class and he made a middle-class decision. He worked within a system that is meant to keep the peons in place, and he's so not a peon it's ridiculous. He "deserves" what he has coming to him.

I'm not saying I agree with the system, but it is what it is, and until it changes, you need to be above it.

This point goes for more than marriage. These rules are not meant for savvy entrepreneurs, rock stars, pro sports players, or politicians. So stop playing by them.

Her talent is her ass and tits... and they are damn fine talents at that. Ass and tits ARE a valuable commodity in our society. In fact, I would argue that her talents are equal to, or surpasses his.

Yes, because division of assets isn't based on fault (which it should be imo).

What's also wrong is that if you get alimony, and your partner moves in with someone else, it only stops if they get remarried.

Very unfair. I wonder why rich Americans don't try to change this law.

Since the act went into effect, the alimony laws in Australia have favored the idea of a "clean break" in the majority of cases, where each party to the divorce is expected to support herself.

The maximum child support payable is also known as the "cap". The maximum child support is applied to the combined income of both parents up to 2.5 times the annual equivalent of all Male Total Average Weekly Earnings (MTAWE) and calculated using the Costs of Children Table.

In 2011, the MTAWE is $61,781. For 2011, the combined income of both parents is capped at approximately $154,453 per year. For example, on the maximum income of $154,453 per year, the costs of three children over 13 years of age are capped at $43,864 per year.

Call me crazy, but I've decided marrying an Aussie would be a better proposition...

Most laws in California are fucking stupid, not all states have that 50/50 bullshit thankfully, even though many judges do it anyway. Alimony is another evil.
 
Bit of a tangent, but this is my view on society:

Dated for a year - Married for 3 - Divorced = Aww they were a REAL couple, shame.

Dating for 6 years: Well their pretty serious I guess.
 
This thread made me look up how current laws are back in Australia...

The court still awards 'alimony' (called spousal maintenance) if the income differential is high enough. In addition, the ex-spouse can make an application for spousal maintenance up to 2 years after the divorce has been finalised (decree absolute).

The laws here are gender neutral, so if the wife is making all the money they husband benefits. But it's a definite kick to the balls if you're the one who brought in all the money while you were married then she gets it all during the divorce because she earns less and has a 'higher need'.

In the Kobe case, if she gets the kids she's probably entitled to more than 50%. She would be in Australia anyway.
 
The real answer to this is if you get married, don't marry a workshy bimbo. Marry a woman who's smart and makes plenty of money as well.

This also has the added bonus that you're less likely to get bored and start nailing your secretary. And you won't have dumb kids.
