So you may or may not remember the domain I was recently trying to sell here - http://www.wickedfire.com/sell-buy-trade/98643-riverislandjeans-com-wts.html

Yeah, River Island have sent me an email & letter saying they're gonna take me to court unless I:

  1. hand over the domain (I sold it on digital point last week!)
  2. hand over all profits made by the phpbay site ($0) and the holding page that's currently being displayed (owned by the guy that bought it)
  3. pay their legal fees
Any advice on what I should do? As I said, I didn't make any money out of the site itself and as I sold it for only $20 I actually made a loss of about $3 - $4 on the domain.

I think I've got until mid-september to reply - what should I do up until then?
 


Speak to a lawyer, but chances are that nothing will come of it.

You didn't sell the domain after River Island contacted you, did you?

I would agree with Mikesev and talk to a lawyer and see what they have to say. Most of the time in internet law suits such as this one nothing ever comes out of them. Then again there have been a few times when there were major lawsuits over the internet. I hope everything works out for you.
 
I would write them a letter saying you sold the domain and do not own it. State to them in your letter that you didnt realize they had a claim to the name and would like to return the $20 you made from selling the site, explain the prior site made no money and include a check saying that by cashing the check i will take this as an agreement to settle your issue for the $20 i made from the sale of the domain.

Or call a lawyer.

Edit: Dont hire an expensive lawyer. They may see it as a sign they can get you for more money. Writing the letter yourself might show them you're a broke ass and spending anymore money to write you letters is useless
 
Talk to your doctor about inducing a coma. Then have your mother go to their offices crying and explain the situation. Get a letter from the doctor stating that stress likely contributed to your condition, then have your mother tell them you're gonna sue them for contributing to your stress and workload.

yeah i get these about every week (lots of them are from gmail accounts pretending to be companies just trying to steal your site) just ignore it man.

This! Makes perfect sense to hand over the money you made from the domain which is petty cash $20, rather than having sleepless nights over the fucking issue. Secondly, the lawyers will charge you atleast $500 an hour to listen to this whole crap. Now you decide what you want? Pay $20 or waste money on a lawyer?

I was once caught in the same issue. I was using a celebrity name and their management team contacted me. They were nice to me and never threatened to sue me but i just gave up the domain coz it wasn't worth fighting over. I actually made over $500 from the domain before i gave up to them lol so it wasn't loss for me :D

It's just a threatening letter to see what they can get out of you. What they're really after is the domain back and a promise you'll never do it again.


I've responded to things like this before telling them I have no assets, and if they sue me I will defend vigorously as a litigant in person, then offering a very small settlement to save us both the hassle.

Most lawyers equate L.I.P. with nutcase who will just run up their bills.

They invariably don't reply or they take the settlement.

Of course, one day they may call my bluff and I'll get raped, so you probably shouldn't do this.
