I read through the TOS and it appears as if there is NOTHING illegal about doing this...
BUT
After speaking with our new FaceBook friend, I now understand why they are a bit pissed, and I would strongly suggest to anyone who is doing it to stop right about now.
Reasons for me suggesting you to stop is because their TOS is going to be changing shortly, and everyone after that period will be held liable for breaking their TOS. Now, unlike other companies who just ban you or cancel your account or give you a slap on the wrist type of punishment, it seems pretty apparent that FaceBook is out for blood to set an example. And that blood is affiliate blood.
During the interesting conversation I was told that they are holding affiliate marketers responsible, NOT the advertisers and NOT the networks, just the people fucking with their system, aka the affiliates. This means that even though they believe they have enough to go and sue some people right now over it, their TOS is pretty flawed, so if you are continuing after this warning, goodluck to you, and you're on your own.
I seriously think their whole customer service/security team over there is run by no more than 5 people at the moment. They were definitely not expecting the pounding they got, and it seems that the spark and fuel for the out of control fire was caused by this thread (WF - 1 Everyone else - 0!). Seems more people read about it, put it into play, and absolutely raped the shit out of it and did more overwhelming damage to one of the biggest sites in the world (and they got paid for it too!) in it's first week, than they had planned for when they launched the service a week ago. I sure would love to see the numbers from them on that! Talk about ego boost.
Anyway, after speaking with them I think it's fair to say that they won't be going after anyone just so long as it calms the hell down over there so that the security/operations crew or whoever is running it on their side doesn't have to spend 20 hours a day for a week and a weekend working nonstop to manage the overwhelming response they got (sorry, but I had to laugh when I heard that). He also agreed that their TOS should clearly outline what you can and cannot do, and when something as easy and powerful at the same time is launched, that there will always be people who rape the system, especially when the smell of easy money is sent into the air.
I'm closing this thread now so to end this insanity. Thank you to everyone who made my night crazy by IM'ing the bejesus out of me. Thanks to the FB team for taking the time out to speak to me and listen to what I had to say in defense of the users here and for also acknowledging that there was no "bad guy" and hopefully no legal action will be taken on anyone who took advantage of the system from anytime before Sept 23rd 2007.
Again, if they catch you after September 23 2007 doing what they consider "against their TOS", you are shit out of luck, and on your own. I am kinda pissed that I didn't get to try this out myself, but I'm also happier to hear that affiliates on WickedFire had such a huge impact on the all mighty Facebook!
