I think what they are looking to portray works, they are not following the crowd and if you look through their website they have a couple of USP's. However I expected a neckbeard response, making every effort to find something wrong with it.

Website loads fine for me, time to upgrade that dial up.

He is saying the opposite, and is spot on. There is little to no way that OP isn't going to get sued out of existence.

Proper rookie business move, taking a risk that has very little upside and colossal downside.

Anyone investing in this "venture" under any basis is mental. I mean give him a loan with his home as collateral (doubtful he has a home) by all means, but for equity or even a royalty is just plain suicide for their money.

Hey guys as some have you read my thread earlier this year i started a brick and mortar E-cig store to try and take advantage of the growing opportunity..

the store is not doing bad.. lots of competition but we did about 24k in gross sales last month with about 13k of that profit..then 3500 in rent and electricity and another 2k in labor im putting a good 6-8 in my pocket every month..

any advice would be appreciated.

COGS: (13,000)
Rent: (3,500)
Wages: (2,000)

Pre-Tax Net Rev. = 5,500

Do not forget that here in the States you always have to pay your business partner Uncle Sam. I do not know how you are incorporated, but if you are not I would highly recommend you get on those professional services (accounting/lawyer) asap. Also when/if you incorporate consider having your shop and smoke juice as separate entities. You will get sued eventually and you do not want to lose everything.
 
To the people who say "the term Walking Dead has been around forever, it's not gonna be an issue" I would like to point out King has patented the word CANDY. That's right. You can't use the word Candy in your game titles anymore because someone has patented it.

I'm not sure if AMC would actually sue you, but if they did they'd probably win, and it's not good business practice to depend on someone's whim. You're new. I'd change the name.

He said 13k profit, COGS was 11k.

quick reality check, trademark your brand name in your trademark class, if you slip through only then can you sleep well without risking your investors' money on potential tm hazards down the road.
if not - you will avoid potentially much bigger repercussions if you'd go nationwide.
tm'ing is unavoidable anyways.
 
He's not ripping off the TV show. the phrase "walking dead" probably pre-dates the show, he adds to it, it's a different industry, etc... Time-warner could still sue and cause trouble but I'm pretty sure he's in the clear here.

It's like if they started a show called "Zombies" and then he made an unrelated e-juice brand called "Zombie Vapors". Doesn't matter.

I can suggest a few good intellectual property books for you to peruse if you'd care to educate yourself on this fascinating subject. Of course, if you prefer to just keep on giving these off the cuff opinions, well hell that's just fine with me too because your post really made me smile ;)

Having said that, just talk to a TM lawyer. Or possibly rebrand regardless to save yourself from headaches.

Saw a bunch of e-cig shops when I was traveling this weekend. Crazy. Some of them are in nice ass locations too. Even the tobacco shops all have e-cig shit these days.
