Copyright and patents as I understand them, are to protect the market of the original developer from potential competitors wanting to ride the gravy train.
If a company has invested any amount in R&D they should be able to recuperate that loss and add profit without hindrance from any other source that did not invest in the original idea. Anyway, I know you know this.
