That's the most polite drunk driving arrest I've ever seen.

In the US the cop would have pulled him out the window and then taken him to jail.

I can't understand half the things they are saying though lol
 
You only need to be sat in the driver's seat to be in charge of the vehicle, plus there were several witnesses.
Not even the drivers seat. You could be sleeping it off in the passenger seat as well. Or even the back seat. Any place where you are "near" the controls of your car can end up with you getting a DUI. An attorney would have more wiggle room if you slept in the backseat though, but you can still get a DUI regardless.

That happened to me before years ago when I was young. Was sleeping in the backseat with a blanket over me, but I had the keys in the ignition (was cold, and I turned the heater on / off). Come about 2am, some dike cop bangs on the window, wakes me up, smells beer on my breath, and proceeds to charge me with a DUI. Her reasoning was because the keys were in the ignition, even though the car wasn't even on.

Didn't blow over at the station though, so they couldn't charge me. Instead they just stuck me in a cell for about 6 hours beside some old guy who snored louder than a tranquilized elk.
