Detained for Open Carry (Guy owns officers)

Wait, a guy can walk down the street with a handgun and a copper can't ask him if he has a permit? Call me a Eurofag but that doesn't make sense. How do you know a person is allowed to carry a gun if you cant ask, seems dumb to me but what do i know

because he should be allowed by default. and thats a fuckin shitty way to say it, because nobodies got to be allowed. thats god given right. the whatever the numbers amendment is is bullshit. it might have been added to the constitution in good faith, but it sets a precedent on how government acts. things cant be allowed, they can only be taken away. no authoritarian body has the ability to grant something im already able to do.
 
Gurilla my only point was this guy was trolling and makeing a situation out of something that shouldn't have been one. That officer wasn't harassing him. He was only trying to determine if he was a threat. Thats it nothing more nothing less.

I think a good officer could observe from a distance to figure out if somebody open carrying is a threat or not without violating the persons rights.

There is NO PERMIT REQUIRED to open carry in Maine and many other states.
 
Three points:

First, a few of you are getting hung up on whether the gun-toting dude was "looking for trouble." Here's a secret: It. Doesn't. Matter. His rights do not change whether he is docile or aggressive, a nice guy or a douchebag.

Suppose the guy walked by the cop with his firearm displayed on his side, and said,

"Fuck you, copper."

"Go eat another donut, you heavy-breathing, low-IQ, badge-brandishing thug."

"Kill any homeless guys, lately, dirtbag?"

"Mmmmm... bacon...."

None of these things diminish his rights. It may make you feel good to think they do, but they do not.


Second, can the cop ask to see the guy's permit? Sure. And I can ask you whether your wife likes to get railed through the back door.

The cop should expect to hear, "Fuck off."

And so should I.

Information can be given voluntarily, or withheld.


Third, it was mentioned the cop was called when others expressed fear about a man walking around with a gun. Frankly, who cares? I know people who become fearful when they see someone smoking a joint. Mention crack or meth, and they nearly shit their pants. Later that night, of course, they may pound a six-pack and threaten their spouse. But that's completely different, right?

The point is, fear is very easy to plant and stoke. There need not be any logic to it. The same is true with a guy carrying a firearm.

On a side note, I'll tell you this...

When I'm at Starbucks, the only time I am fearful - and I've been there when people have ranted, raved, and in one case, come in with blood spilling on the floor from his wrists (a bad suicide attempt) - is when a cop comes in.

And I can tell you stories that would make you realize that THAT fear - my fear of cops - is rational.

I think a good officer could observe from a distance to figure out if somebody open carrying is a threat or not without violating the persons rights.

There is a reason "Gun Control" laws dont work... Criminals, by definition, don't abide by the laws!

I know it takes energy to think for yourself, but what a country/world we would live in if more people made the effort!

For the slow-witted: I don't like cops
Last week I was leaving to meet a buddy of mine for dinner. I had a tail light out. So I get pulled over like 2 houses down from my house. Nothing scares me more than cops, and I've seen some scary shit.

I've never been arrested, I wasn't doing anything illegal beyond the tail light, but all I can think about when dealing with cops is they can lock me up or kill me if they want to.

So there's two of them, they walk up on both sides of the car, I have my hands on the wheel and I'm polite to them.

I guess it was apparent that I was pissed off/nervous. While one is running my ID for warrants the other is asking me all kinds of questions about where I'm going, and then asked what my tattoo says.

I told him it's a Jimi Hendrix quote. That was a mistake.

I drive a nice car. I'm clean cut. I live in a nice neighborhood. The only thing they had on me is that I like Jimi Hendrix. That was enough.

They come back and ask "what my problem" is. I was being polite with them. I told them I just don't like being pulled over. They ask if I have any drugs, I say "no". They go on to say it's going to be a lot easier if I just tell them, because they're going to find out anyway, etc.

They ask me if they can look inside the car. I tell them "I'm in a hurry, I'm not consenting to a search".

Cop comes back with "come on man, I'm being cool with you, I could give you a few hundred dollars in tickets, it won't take me 2 minutes to peek around, just be cool with me, if you're not hiding anything what's the problem?"

I should definitely know better, but just wanting them to leave me alone and knowing there's nothing they'd find I was like "whatever, take a look". So I get out, and cop #2 takes me, bends me over my hood and tells me to put my hands behind my back. He holds me there for about 10 minutes while they pat me down and go through all of the shit in my car.

Finally they let me go, no ticket or anything. But I'm still fucking pissed about it. They had me bent over the hood for 10 minutes in front of my neighbors looking like I'm being arrested, and even though I consented to it, I still feel like they were dicks and violated my privacy.

It turned out best cased scenario, but all it would take is someone dropping a pill in my car, or even the cop planting some shit to put me away. It may sound paranoid but there's a lot of people in prison who thought they had "nothing to worry about".

Three important reminders here...

1. Don't put yourself in a position where you have to deal with cops. I hadn't been pulled over in over 10 years. Not checking my lights put me in that position.

2. Don't talk to the police. I was trying to be cooperative so they'd hurry up. There's no "polite" conversation with cops, they're looking for a reason to press you. The questions about drugs came up immediately after the cop said "that's a cool tattoo, what's it say?" The second I said "Jimi Hendrix" it was like they thought I had a pound of weed in the car.

3. Don't consent to a search. They're very good at persuading you to do so. They basically said "cooperate or we're going to figure out a way to fuck you". I caved, I should have told them to hand me the ticket, even though they said otherwise they didn't have anything beyond the light to write a ticket for.

tl;dr - FUCK THE POLICE.

there is not a single piece of information you can give to a police officer that can help your situation in any way.
 
That's not my rationale. My rationale as you put it, is that the police should be able to challenge someone carrying a deadly weapon, IMO.

Random stop and searches no, requesting ID for carrying a deadly weapon yes.


Are cars deadly weapons? Yes, they can be.
Are baseball bats deadly weapons? Yes, they can be.
Are screw drivers bats deadly weapons? Yes, they can be.
Are fists deadly weapons? Yes, they can be.

So , if police had the 'right' to investigate everyone carrying something that could be used as a deadly weapon, then you have a major problem.

On top of that, during hunting season all across the US it's common practice to carry a firearm. While driving around on any given shotgun season day in my area, I'll see no less than 50 to 100 individuals carrying around shotguns or handguns. Hunting and firearms are just part of the lifestyle in the US, just like it is in Switzerland.

The problem is, many people in the US now grow up in heavily urban areas and see firearms as only good for killing people, and nothing else. Because of this they feel that everyone who owns or carries a gun must be up to no good and therefor attempt to use the law to suppress people who exercise their right to carry a firearm.
 
Pretty weird to be walking around with a gun on your belt. Sends out a weirdo message to be honest. This isn't Bluff, Alaska in the gold rush lol. Probably some dweeb who feels powerful. I can understand carrying a gun for self defense, particularly if you live around minorities, but open carry just seems douchy.
