Lol did anyone ever see the American Greed on the enzyte guy? The best part was when they read some of his emails that he sent to biz partners and friends he basically said he came up with the entire scheme after taking several bong tokes.
 
$450million is way too much money for him to not do any time at all.

It's really going to depend on how good of a case there is with charging Jesse with wire fraud and related charges.

If his rebill pages stated the cost of the service, I think it'll be difficult to prosecute him criminally but relatively easy to prosecute him civilly.

I've seen some of Jesse's pages, and they seemed to show the cost of service but it wasn't particularly obvious. You had to look through the fine print.

Also lets not forget that Jesse is a Canadian citizen living in Canada which will also require extradition to the US if there are criminal charges.

Yeah, but Canada would likely allow for extradition in this case. They've been extraditing AWOL soldiers and draft dodgers recently, so I don't see them having a problem extraditing Jesse if necessary.

Correct, but extradition raises the stakes since it can take a while if the defendant fights it in court and Jesse certainly has the resources to do so. The US government would only extradite if it's confident it can successfully convict a defendant.

Also AWOL soldiers and draft dodgers are US citizens who clearly broke the law, it's really a no brainer to extradite them. If Jesse got indicted, it would be a tad more tricky since he's a Canadian citizen who will probably hire the best extradition defense lawyers available.

It took four years to extradite Marc Emery from Canada. So the US is going to absolutely have to have an air tight criminal case against Jesse since it's going to take a while just to get him into a US court room.

Edit: Also at this point Jesse is a free man. He can travel anywhere. What if he moves to a country with no extradition treaty, such as China?

So why did the Warshak of Enzyte get fucked with 100 counts + and fed time when what he did is similar to Wilms' operation?

In order to cancel the rebill you had to get a doctors note saying you had a small penis. even after all that bullshit they still allowed the company to run free trial penis pills after cleaning it up a bit.

Kevin Trudeau's marketing stuff is a completely different scenario, but it's worth noting that he has never had to go to jail for it, despite being fined for around $40 million.

I saw his infomercial just like 2 weeks ago. He's running strong as ever.
 
Truthfully, no. When you are in a hurry to bring your site online, you don't always do your legal homework first...It wasn't until I was selling a hundred pairs a day that I decided to look into the legalities.

The product I was selling wasn't marketed as 'contact lenses'. It's been documented that the FDA had NO idea about the product until a New York Times article was released.

Something that the FTC hates is bad press. Before the FTC allegations came out about Jesse, he had plenty of bad press, so they had to act. At the end of the day, whatever the FTC wants they get.

What do you mean double dinging of credit cards? He charged the customer twice when he only ordered one product? I'll have to look into this whole Enzyte case a bit.

I answered my own question. Turns out he split the product and the shipping and handling fee into two separate charges. Later on he even did triple dinging.
