Only if you sue them. So what was the read out on the breathalyzer? He had to tell you? They should have the results back fairly soon on the blood. What are they going to find in your system? Are you on any prescriptions? Even if you dont think it matters it might? Have you contacted the hospital that did the test? Or did they do them in house? How did you get released? Did you have to go to any court yet? Did you bond out?

The burden of proof is on you. Depending on when this happened it may be worthwhile to go get another blood test (the sooner the better) by an independent physician to prove your clean (it might not help even if you do this)

I'm worried because the cop was the person in possession of my piss and blood. They just released me to my mom after the blood and piss test. My mom had to pick me up because they towed my truck right away.

Get a lawyer and get independent tests done today so you have proof... But I wouldn't wait, go find a clinic that can test you tonight.
 
The people who are extorting money from the OP are criminals, and they don't care about proof, they have no right to ticket him in the first place.

No amount of tests or appeal to "the law" which in most cases is shit they make up, is going to help the OP. They want his fucking money. They want his fucking liberty and they are going to get both if he tries to play their game.

You can opt for a blood test rather than breath, it's more accurate and takes longer

Ah, so i guess it could be a strategic advantage? Still, just wait until that shit is mandatory. It just seems sooo foreign and strange to me that, while driving in my a car, another (usually lessor) human being has the right to stop me in the middle of my leisurely car ride, and TAKE MY FUCKING BLOOD! LOL... Fuck that.

I've seriously been sober for 2 years now and I'm shocked that this happened. I can't believe cops have so much authority without proof of anything.

I'm not sure if it ever passed, but in Dallas a while back they were talking about arresting people that were sick or tired for a DUI.
 
No Positive Blood, No ETOH (alcohol) - no case, you would have had to told them you were drunk or high otherwise. I have been sober a long time I would fucking laugh at them, never the less it is going to cost you lawyer fee's, you will get off the DUI unless you refused to give blood or Breathalyzer they have no case at least not here in Texas... Arizona not sure.

incorrect. The burden of proof is on the state. Innocent until proven guilty. its rather hard to prove a negative. If the cop can not bring evidence forth that proves that OP was under the influence of alcohol at the time of the ticket it will be tossed out of court. So either the OP is leaving out facts or this case is a non-starter.

if you believe this, i pity your naivete. in practice, our society is built on the systematic repression of liberty. where does anyone, nevermind the government, get off regulating what i may and may not have in my bloodstream?

cops are raging mediocrities who love wearing their magic badges, which make most people give them the respect and authority they would never garner on their own merit. they not only excercise coercive force (which is, in my book, the most immoral thing any human being can do) all day, every day - they accept money for it, which makes them not just authoritarians but authoritarians via whoredom.

what are the chances this particular cop is so sure of himself that when the tests come back negative he fudges it so they aren't? he's been a cop for 10 years after all and knows everyone, what are the chances he's got a hook-up for that? this won't be a jury trial either (not that an AZ jury is worth anything anyway) and you can bet the judge thrives on feeling like the big man throwing the book at deviants and evil-doers (everyone who ends up in his courtroom) and only too happy to take the word of a pig over anyone else's any day.

if you've got the resources, get your own tests, lawyer up, beat the charges and sue the crap out of the police department and the city. if nothing else, it'll create problems for them and that's a tremendous satisfaction in itself. in my misspent youth (on a different continent), i've gotten two cops fired (liked planting evidence), one demoted from major to lieutenant (lowest possible rank) and threw one out onto the street by buying his rent-controlled apartment, terminating his lease with 2 days notice and flipping at a 10% loss ($5k well spent, in my book - he was a neo-nazi riot cop).

I don't understand if they were charging you with a DWI you would have gone to jail, if you failed the breathalyzer, he would have handcuffed you and taken you to get you processed, you would go to jail and you would have to bond out.

What the hell is that? Did he take you to jail and arrest you and formally charge you with the DWI? Or did you just get tickets for something that you don't understand what it is? They don't just take your breath tests, blood, etc. tell you we'll see you in 30 days, go back to their lab and let you go like that.

If there's suspicion of a DWI and you're pulled over, that's it. You are going to jail right then and there. They'll ask you to do sobriety tests, I forgot it's been a while but, pretty sure you can refuse breathlyzier, I don't remember about blood or not but, some people say since it takes time to get to the jail that you could start sobering up during that time or get lower results, so some people do that. If you fail any of the tests right then and there, that's it, you're going to jail. Even if they take your blood they don't wait for results to return, you still go to jail, get charged processed, have to get bonded out etc.

Anyway the point is either you got charged or you didn't, they aren't off with your test results and waiting to get back to you on it. That doesn't happen with DWI's.
